تعد آلية الشكاوى من أهم الآليات الإجرائية الدولية المخصصة للحد من انتهاكات حقوق الإنسان والمرتكبة على الصعيد الوطني، وذلك من خلال إعطاء الحق للأفراد والجماعات إمكانية تحقيق سبل انتصاف فوق وطني، والحد من السيادة الداخلية للدول، بتقديم شكاوى في إطار منظومة الأمم المتحدة سواء كان من خلال آلياتها الاتفاقية، والمعني بها اللجان المنشأة بموجب الاتفاقيات الدولية لحقوق الإنسان والتي تنظر في الشكاوى الفردية فقط بعد استنفاد سبل الانتصاف المحلية، أو غيرها من الآليات والإجراءات غير الاتفاقية –محل الدراسة- والمختصة بالشكاوى الفردية والجماعية على حد سواء والتي تكشف بالأدلة الموثقة عن نمط ثابت من الانتهاكات الجسيمة لحقوق الإنسان، والمتمثلة في الإجراءين رقمي 1235، 1503 الصادرين عن المجلس الاقتصادي والاجتماعي وهي إجراءات تقع خارج نطاق اتفاقيات حقوق الإنسان، ويطلق على الإجراء الأول اسم الإجراءات الخاصة، وهو الاسم العام الذي يطلق على الآليات التي اختصت بها لجنة حقوق الإنسان سابقا، واستلمها مجلس حقوق الإنسان حاليا لفحص حقوق الإنسان في بلدان أو أقاليم محددة، ويتميز بأنه علني بينما يطلق على الثاني الإجراء السري، بالإضافة لإجراء لجنة مركز المرأة والمختص بالنظر في الشكاوى التي تكشف عن وجود نمط ثابت من الممارسات الجائرة والتمييزية ضد المرأة ومعالجتها.
The complaints mechanism is considered as one of the most important international procedural mechanisms that is designed to curb human rights violations at the national level, by giving individuals and groups supranational remedy, limiting the internal sovereignty of states, and by submitting complaints within the framework of the United Nations system either through its convention mechanisms ( i.e. the committees established under international human rights conventions that consider individual complaints only after domestic remedies), or other mechanisms ( any other mechanisms other than the convention, the subject of the study ) which is concerned with individual and collective complaints alike, which show by documented evidence the consistent pattern of gross violations of human rights, and this is clear in procedures no. 1235 and 1503 issued by the Economic and Social Council, which are considered as measures that are outside the scope of human rights conventions. The first procedure is called the special procedure, and it is the general title given to the mechanisms that previously held by the Human Rights Committee and by the Human Rights Council nowadays to examine human rights in certain countries or territories . This procedure is characterized as being public, while the second measure is called the secret one , in addition to the Women's Status Committee procedure that is designed to look into complaints that reveal a consistent pattern of unfair and discriminatory practices against women .
