المستخلص: لقد جذب نطاق جريمة الإبادة الجماعية وتعريفها ومفهومها اهتمام العديد من خبراء القانون والباحثين في مجال القانون الجنائي الدولي. وتتلخص مشكلة البحث بالبحث في بيان ماهية الإبادة الجماعية، وما كفاية المصطلح للتعريف بالجريمة. وتنطلق أهمية الموضوع من أهمية دراسة الجهود المبذولة على المستويين لمكافحة جريمة الإبادة الجماعية، والعقبات التي تحول دون فعالية الآليات وإيجاد حلول وعقوبات رادعة لمن يرتكب هذه الجريمة. وسيتبع الباحث في الدراسة المنهجين الوصفي التحليلي والمقارن من خلال تعريف الإبادة الجماعية ونقد التعريف ومدى تعديله، والمقارنة بين الاتفاقيات الدولية المعنية بتعريف جريمة الإبادة الجماعية. وينقسم البحث إلى مبحثين الأول: تعريف الإبادة الجماعية والعوامل المسببة لها، وينقسم إلى مطلبين: الأول: تعريف الإبادة الجماعية، والثاني: العوامل المسببة للإبادة الجماعية، والمبحث الثاني: الانتقادات الموجهة لتعريف جريمة الإبادة الجماعية، وينقسم إلى مطلبين: الأول: نقد تعريف الإبادة الجماعية والثاني: مدى الحاجة لتعديل مصطلح الإبادة الجماعية. وقد توصل الباحث إلى نتائج هي: أنه منذ أوائل التسعينيات تم استخدام تعريف الإبادة الجماعية الذي قدمته الأمم المتحدة على نطاق واسع، إلى جانب الدعم والقبول على المستوى الدولي لإدانة العديد من مرتكبي هذه الجريمة وإنشاء سوابق قانونية. واقترح الباحث توصيات تتمثل في أن التوسع في إدراج المجموعات المحمية واستبعاد بعض العناصر المادية هو الحل الوحيد البسيط لمشكلة التعريف، ويجب التوسع في استخدام التقنيات الحديثة لوضع تعريف أكثر دقة للإبادة الجماعية.

The scope, definition and concept of the crime of genocide have attracted the interest of many legal experts and researchers in the field of international criminal law. The research problem is summarized in the research in explaining what genocide is, and the adequacy of the term to define the crime. The importance of the topic stems from the importance of studying the efforts made at the two levels to combat the crime of genocide, the obstacles that prevent the effectiveness of the echanisms, and finding solutions and deterrent penalties for those who commit this crime. The researcher will follow the descriptive, analytical and comparative methods of the study, by defining genocide, criticizing the definition and the extent of its modification, and comparing the international conventions concerned with defining the crime of genocide. The research is divided into two sections, the first: the definition of genocide and the factors causing it, and it is divided into two requirements: the first: the definition of genocide, the second: the factors causing genocide, and the second section: criticisms of the definition of the crime of genocide, and it is divided into two requirements: the first: criticism of the definition of genocide collective. The second: the need to amend the term genocide. The researcher reached the following conclusions: Since the early 1990s, the definition of genocide given by the United Nations has been widely used, along with support and acceptance at the international level, to convict many perpetrators of this crime and to establish legal precedents. Recommendations are: Expanding the inclusion of protected groups and excluding some material elements is the only simple solution to the definition problem, and we must expand the use of modern technologies to develop a more accurate definition of genocide.
