مما لا شك فيه أن علم القواعد الفقهية من أهم العلوم بعد توحيد الله تعالى؛ لأن الوقائع تتجدد بتجدد الزمان والمكان، والإحاطة بها جميعاً أمر يصعب على المتعلم في الشريعة، لكن ضبط الفقه بقواعده يعين على الإلمام بالمسائل ومعرفة حكم الشرع فيها، وقد تناول هذا البحث الجانب التطبيقي لقاعدة: المشقة تجلب التيسير من كتاب الأشباه والنظائر للإمام السيوطي رحمه الله، وقد قارنت بين منهجه، ومنهج ابن نجيم رحمهما الله في عرض القاعدة، وقد وقع اختياري على هذين المصنفين الجليلين، والذي أحدهما ينتمي إلى المذهب الحنفي، وهو كتاب «الأشباه والنظائر على مذهب أبي حنيفة النعمان» للعلامة زين الدين بن إبراهيم ابن نجيم المتوفى سنة 970 ه، والثاني ينتمي للمذهب الشافعي، هو كتاب «الأشباه والنظائر في قواعد وفروع فقه الشافعية» للعلامة جلال الدين عبد الرحمن السيوطي، المتوفى سنة ٩١١ ه، لكون كلاً منهما يعتبر مصدرًا في فن القواعد الفقهية في مذهبه بالإضافة إلى شهرة الكتابين واعتماد من جاء بعدهما من العلماء على الكتابين المذكورين. وتناول هذا البحث الحديث عن التطبيق لقاعدة المشقة تجلب التيسير من كتاب الأشباه والنظائر للإمام السيوطي رحمه الله، وقد احتوى على مقدمة، وفيها مفردات البحث باختصار، وثلاثة مباحث: الأول: التعريف بالقاعدة وفيه ثلاثة مطالب: الأول: التعريف بالقاعدة الفقهية، الثاني: معنى قاعدة المشقة تجلب التيسير، الثالث: أدلة القاعدة وتأصيلها الشرعي، المبحث الثاني: مقارنة بين منهج السيوطي وابن نجيم في عرض القاعدة، وفيه مطلبان: المطلب الأول: مقارنة في ترتيب وعرض القاعدة، المطلب الثاني: مقارنة الفوائد المذكورة في آخر القاعدة، المبحث الثالث: الجانب التطبيقي للقاعدة من كلام السيوطي رحمه الله، وفيه مطلبان: المطلب الأول: أسباب التخفيف عند السيوطي، المطلب الثاني: فوائد مهمة على قاعدة المشقة تجلب التيسير، وقد توصل الباحث إلى مجموعة من النتائج أوردها في الخاتمة.
There is no doubt that the knowledge of jurisprudential rules is one of the most important knowledge after the monotheism of God Almighty. Because facts are renewed with the renewal of time and place. Comprehending all of knowledge is difficult for the learner. However, controlling jurisprudence with its rules helps to become familiar with the issues and to know the Islamic ruling on them. This research dealt with the applied side of the rule: hardship brings facilitation from the book of similarities and analogues of Imam Al- Suyuti, May God have mercy on him, I have compared his theory to that of Ibn Nujaym, may God have mercy on them both, in the presentation of the rule. My choice fell on these two great works. Which one of them belongs to the Hanafi school of thought, which is the book “Al-Ashabah wa al-Naza’ir on the madhhab of Abi Hanifa al-Nu’man” by the scholar Zain al-Din bin Ibrahim Ibn Najim, who died in the year 970 AH, The second belongs to the Shafi’i school of thought, and it is the book “Al-Ashabah wa’l-Naza’ir fi Qaa’id wa Fru’u’ fiqh al-Shafi’i” by the scholar Jalal al-Din Abd al-Rahman al-Suyuti, who died in the year 911 AH, Because each of them is considered a source in the art of jurisprudential rules in his doctrine, in addition to the fame of the two books and the reliance of the scholars who came after them on the two critical books. This research dealt with how applying the rule of hardship brings facilitation from the book of similarities and analogies (Al Ashbah Wa Nazahir) of Imam Al-Suyuti, may God have mercy on him, it contained an introduction, in which the research vocabulary is briefly mentioned. And three topics: the first: the definition of the rule, and there are three sub-topics, The first sub-topic: Defining the jurisprudential rule. The second sub topic: the meaning of the rule of hardship brings facilitation. The third sub-topic: the evidence of the rule and its legal foundation. The second topic: A comparison between the methodology of Al-Suyuti and Ibn Najim in the presentation of the rule hardship brings facilitation. The Third Topic: The practical aspect of the rule from the words of al- Suyuti, may God have mercy on him, the researcher reached a set of results, which he mentioned in the conclusion.
