المستخلص: يعد موضوع مختلف الحديث من الموضوعات التي كثر فيها الاختلاف في الآراء والأنظار بين الفريقين، لكثرة الدواعي، والأسباب الموجبة للاختلاف في الحديث، فمنها ذاتية داخلية، أخرى خارجية، نتيجة ما تعرض له الحديث بعد النبي الأكرم (صلى الله عليه وآله وسلم) من وضع ودس وخلط، وتزوير وكذب على النبي (صلى الله عليه وآله وسلم) مما أدى إلى تداخل الأحاديث واختلاط بعضها مع البعض الآخر، أو اختلاف الرواة في نقل الحديث باللفظ. ومن أسباب اختيار هكذا موضوع هو الرغبة في التعرف على آلية التعاطي مع الأحاديث المختلف فيها، وكيفية الاستفادة منها عند علماء الفريقين. وكذلك من فرضيات هذا البحث هو ذكر علماء الفريقين عند البحث عن مختلف الحديث، طرقاً متعددة لمعالجة الاختلاف فيها، ومنها اللغة العربية وعلوم القرآن وما يخص الفقه الإسلامي والبيان العربي ودراسة المتون والدراسات التحليلية وهذا بحد ذاته مشتركات ومفترقات الفريقين. ومن أهداف هذا البحث هو بيان أن من أساليب وطرق معالجة مختلف الحديث، هي طرق ترقيعية، فلا ينبغي الاعتماد عليها في الاستفادة من هذه الأحاديث المختلف فيها؛ لعدم صلاحيتها لحل المشكلة فيها. وكذلك تبيين وجوه الآراء المتعددة لدي علماء المسلمين حول مختلف الحديث ومشكله حتى نهاية القرن الخامس الهجري. وكانت منهجية البحث اعتمد على المنهج الاستقرائي الوصفي من جهة، والنقدي من جهة أخرى، لمسائل وموضوعاتها وتطبيقاتها، وذلك من خلال تتبع مظانها في الكتب والدراسات والرسائل والأطاريح والبحوث، وما صنف في باب الحديث المختلف وأسبابه عند الفريقين. وأن المراد بمختلف الحديث هو وجود حديثين مقبولين متضادين في المعني الظاهر. وأنه ليس هناك اختلاف حقيقيي بين الأحاديث، وإنما الاختلاف عائد إلى نظر المجتهد. وأن ثمة فرق بين مختلف الحديث ومشكل الحديث، كما أن هناك أسباب تؤدي إلى وجود الاختلاف بين الأحاديث. إن الإمام ابن حزم اتفق مع غيره من العلماء في الجملة في منهج توجيه الأحاديث التي ظاهرها الاختلاف، وانفرد في مسألة اعتبار الناقل من الأصل من طرق معرفة الناسخ والمنسوخ.

The subject of “various hadith” is one of the topics in which there is a great deal of difference in opinions and consideration between the two teams, due to the large number of reasons and reasons for the difference in the hadith. , and forgery and lying to the Prophet (PBUH), which led to the overlapping of hadiths and mixing of some with others, or the difference of narrators in transmitting the hadith verbally. One of the reasons for choosing such a subject is the desire to learn about the mechanism of dealing with hadiths in which there is disagreement, and how to benefit from them among the scholars of both teams. Also, one of the hypotheses of this research is the mention of the scholars of the two teams when searching for different hadiths, multiple ways to deal with the difference in them, including the Arabic language and the sciences of the Qur’an and what is related to Islamic jurisprudence and the Arabic statement and the study of texts and analytical studies, and this in itself is the commonalities and divergences of the two teams. One of the objectives of this research is to show that among the methods and methods of dealing with various hadiths are patchwork methods, they should not be relied upon to benefit from these controversial hadiths. due to its inability to solve the problem. As well as clarifying the faces of the multiple opinions of Muslim scholars about the various hadiths and their problem until the end of the fifth century AH. The research methodology relied on the descriptive inductive approach on the one hand, and the critical approach on the other hand, for issues, topics and applications, by tracking their perspectives in books, studies, letters, treatises and research, and what was classified in the different hadith section and its reasons for the two teams. And that what is meant by different hadiths is the existence of two acceptable hadiths that are contradictory in the apparent meaning. And that there is no real difference between the hadiths, but the difference is due to the view of the mujtahid. And that there is a difference between the various hadiths and the problem of the hadith, and there are reasons that lead to the existence of differences between hadiths. Imam Ibn Hazm agreed with other scholars in the sentence in the approach of guiding hadiths that appear to differ, and he was unique in the issue of considering the transmitter from the original as one of the methods of knowing the abrogated and the abrogated..
