للبعد الروحي في حياة الإنسان أهمية ومكانة خاصة، لا بد من وضعها في موضع الحماية، ويرتبط البعدان الروحي والعاطفي للإنسان بشكل مباشر ببعض الأماكن التي يتم إضفاء طابع القدسية عليها، وقدسية هذه الأماكن مستوحاة من النصوص الدينية أو الوقائع التاريخية المرتبطة بالدين، وللأماكن الدينية المقدسة أهمية كبرى في حياة الإنسان من حيث اتخاذها مقراً لممارسة الشعائر الدينية، أو اتخاذها مقرا للقضاء أو لبعض الأعمال الإدارية والعسكرية، فضلا عن إنها تشكل في الوقت الحاضر احد روافد الاقتصاد المحلي للبلدان لما تشكله من وجهة محببة للسياحة الدينية . ولهذه الأهمية الخاصة للاماكن الدينية المقدسة دأبت التشريعات الوطنية والدولية على إيجاد نوع خاص من أنواع الحماية لهذه الأماكن، ولا سيما أن هذه الأماكن قد أصبحت هدفاً للكثير من أعمال الإرهاب، بل أصبح استهداف القيم والمبادئ التي يمثلها المكان المقدس من أولويات بعض الحركات التي تريد النيل من قدسية هذه الأماكن لتزيل صفة القدسية عنها.
