|a إن الله تعالى لم يخلق شيئا عبثا بل خلق كل شيء لغاية ومقصد، فإن مقاصد الشريعة هي الأهداف التي يرمي إليها الشارع الحكيم، أو هي المقصود بالتكاليف الشرعية، ومن أجل تحقيق "المقاصد الشرعية ودورها في حفظ النسل " شرع لهم أحكام التي تحفظ لهم مصالحهم، وهذه الأحكام تستند إلى أدلة أذن الشارع أن يستدل بها، وحفظ النسل يراد به حفظ النوع الإنساني على الأرض بواسطة التناسل ذلك أن الإسلام يسعى إلى استمرار المسيرة الإنسانية على الأرض حتى يأذن الله بفناء العالم ويرث الأرض ومن عليها. فإن من حق هذه الشرع علينا أن نفهمه، ومعرفة مقاصده، ومن مقاصده حفظ الضرورات التي جاءت بها الشريعة لصلاح الناس في معاشهم ومعادهم، حفظ الضرورات الخمس وهي: الدين والنفس، والعقل والمال والنسب التي لا بد منها في قيام مصالح الدين والدنيا، بحيث إذا فقدت لم تستقم مصالح الدنيا بل صارت إلى فساد وتهارج.
