المستخلص: أكدت المواثيق الدولية على حق الإنسان في السكن اللائق، كأحد الشروط الرئيسية لإنسانيته وحقوقه الطبيعية التي تقع على الدولة مسؤولية توفيرها باعتبارها الجهاز الإداري المسؤول عن خدمة المواطن وتيسير سبل عيشه وإدامة بقائه. فالشعور بالأمان والاستقرار النفسي يعد أحد الشروط الأساسية لإدامة حياة الإنسان واستمرار بقائه، ولعل حق العيش في سكن لائق يحفظ للإنسان كرامته وهو يعتبر ثاني أهم الشروط والحقوق الواجب توافرها للإنسان، بعد حقه في الحصول على لقمة العيش الكريمة. لذلك فالسكن اللائق المستقر يوفر شعور بالحماية ضد العوامل المهددة لأمانه واستقراره. كما إنه يشكل أحد العناصر الرئيسية لقيام الأسرة التي تمثل الأساس لأي مجتمع إنساني، ويعد غياب السكن اللائق من بين أهم الأسباب التي تهدد بناء المجتمع. كما حظي الحق في السكن اللائق برعاية دولية من قبل المجتمع الدولي تمثلت في الاعتراف بهذا الحق في المواثيق الدولية حيث قام المشرع الدولي بإصدار مجموعة من الاتفاقيات الدولية والإقليمية كان موضوعها حقوق الإنسان ومن ضمنها الحق في السكن اللائق وعلى الدول التي تنظم إلى هذه الاتفاقيات أن تلتزم باحترام وحماية وأعمال هذا الحق.

International covenants affirmed the human right to adequate housing, as one of the main conditions for his humanity and his natural rights, which the state is responsible for providing as the administrative body responsible for serving the citizen and facilitating his livelihood and sustaining his survival. The feeling of safety and psychological stability is one of the basic conditions for sustaining human life and the continuation of his survival. Perhaps the right to live in decent housing preserves human dignity, and it is considered the second most important condition and right that must be available to a person, after his right to obtain a decent living. Therefore, adequate and stable housing provides a sense of protection against factors that threaten its safety and stability. It also constitutes one of the main elements for the establishment of the family, which represents the basis of any human society, and the absence of adequate housing is among the most important reasons that threaten the building of society. The right to adequate housing has also received international sponsorship by the international community, represented in the recognition of this right in international conventions, where the international legislator issued a set of international and regional agreements whose subject was human rights, including the right to adequate housing, and the countries that organize these agreements must adhere to respect protection and fulfillment of this right.
