|a إن أهم ما يميز الحقوق هو أنها تثبت لأي فرد ولمجرد كونه إنسانا، فهي تستهدف حماية المظاهر المختلفة لعناصر الشخصية ومقوماتها وذلك من أفعال الشخص ذاته ومن اعتداء الأفراد الآخرين، فالإنسان ومنذ القدم كان محورا للدراسات القانونية التي كانت في محصلتها النهائية تستهدف حمايته وتكريمه وصيانة ماله من حقوق كان للحقوق المالية مكان الصدارة فيها، وبمرور الوقت وبتطور الأفكار القانونية بدأت أهمية الحقوق غير المالية بالتزايد واتجهت الأنظار صوب هذه الحقوق والتذكير بأهميتها، وقد كان للفقه الإسلامي واهتمامه بالإنسان بتكريمه وتبجيله عما سواه وقع كبير في تنامي وتطور الحقوق غير المالية.

Since ancient times, the human being has been the focus of legal studies whose final outcome was aimed at protecting him, honoring him, and preserving his money from Rights had financial rights at the forefront, and with the passage of time and with the development of legal ideas, the importance of non-financial rights began to increase, and attention turned towards these rights and reminding them of their importance.
