المستخلص: أخذ الناس ينفرون من العمل الأمني والمخابراتي؛ لأنهم يرونه عملا لا ينسجم مع الأخلاق، ينطلق من المبدأ سيء الصيت (الغاية تبرر الوسيلة)، والقائمين عليه هم أناس قد نزعت الرحمة والشفقة من قلوبهم، فلا توجد في حياتهم إلا الشدة والقسوة، وبذلك تحول العمل الأمني والمخابراتي من وسيلة يستعين بها الإنسان لتوفير الأمن والاستقرار له ولمجتمعه إلى خطر قد يداهمه في أية لحظة فيفقده حريته واستقراره، بل وربما حياته أيضا. لذلك وجد الباحث من الضرورة إلقاء الضوء على مثل هكذا مسائل فقهيه معاصرة، حيث يعد التحري الأمني إحدى الموضوعات الفقهية المهمة والجديدة في مجال الفقه المعاصر، خصوصا وأن التحري الأمني يعد وسيلة عسكرية وأمنية غاية في الخطورة والأهمية بالنسبة للمجتمع والأفراد الذي يقعون تحت وطأته، خصوصا مع الإشكاليات المجتمعية التي يعاني منها أفراد المجتمع نتيجة إجراءات التحري الأمني التي تتم في بعض الدول الإسلامية بعيده عن شروط وأحكام الفقه الإسلامي المعاصر، لذلك وجد الباحث نظرا لقلت الدراسات والأبحاث في هذا المجال ضرورة الاهتمام به وتسليط مزيد من الضوء عليه أملأ في الخروج بتوصيات إلى الجهات المختصة من أجل معالجة الواقع الأمني المتعلق بالتحري، ونظرا لارتباط هذا السلوك (التحري الأمني) بحقوق الأفراد في الدولة وواجباتها، فقد وجد الباحث من الضرورة إلقاء مزيد من الضوء على هذا الموضوع من خلال بيان أشهر صور التحري الأمني مع الإشارة إلى حكم كل نوع من أنواع التحري الأمني.

People started to feel alienated from security and intelligence work. Because they see it as an act that is not in harmony with morals, and is based on the notorious principle (the end justifies the means), and those responsible for it are people who have had mercy and compassion removed from their hearts, so there is nothing in their lives except distress and cruelty, and thus security and intelligence work has been transformed from a means that people use to provide security. And stability for him and his society leads to danger that may attack him at any moment, causing him to lose his freedom and stability, and perhaps even his life as well. Therefore, the researcher found it necessary to shed light on such contemporary jurisprudential issues, as security investigation is one of the important and new jurisprudential topics in the field of contemporary jurisprudence, especially since investigation Security is a military and security method that is extremely dangerous and important for society and the individuals who fall under its influence, especially with the societal problems that members of society suffer from as a result of the security investigation procedures that take place in some Islamic countries that are far from the terms and provisions of contemporary Islamic jurisprudence. Therefore, the researcher found that due to the scarcity of studies Research in this area requires attention and shedding more light on it in the hope of coming up with recommendations to the competent authorities in order to address the security reality related to investigations. Given the connection of this behavior (security investigation) to the rights and duties of individuals in the state, the researcher found it necessary to shed more light. On this topic by explaining the most famous forms of security investigation, with reference to the ruling on each type of security investigation.
