تتناول هذه الدراسة التعقبات الأصولية التي أوردها الشيخ أحمد بن قاسم العبادي على الشيخ تاج الدين الفزاري المشهور بالفركاح في شرحه الصغير على متن الورقات، وتكتسب هذه التعقبات أهمية للمتخصصين في علم أصول الفقه؛ نظرا لمكانة العلمين محل الدراسة، وتنوع هذه الاستدراكات ومما خلصت إليه في البحث: أن غالب التعقبات هي فيما تختلف فيه وجهات النظر، وليست من الأخطاء الصريحة، وبعضها منطلق من اهتمام الشارح؛ فالفزاري مهتم بالفقه في شرحه للورقات بخلاف العبادي الذي ظهر عليه الاهتمام بعلم الكلام أكثر، ومن النتائج ظهور منزلة الشرح الأول للمتن بين بقية الشراح بعده حيث إن غالبهم يستفيد منه في شرحه أو يستدركون عليه لتقويم ما بينه من الآراء، وامتاز شرح الفزاري أنه يورد بعض الاعتراضات والمخالفات للمتن، وقد بلغ عدد التعقبات أحد عشر تعقبا، بينت فيها موضع التعقب في المتن أولا ثم بيان موقف الشارح ثم أذكر التعقب من العبادي وأختم ببيان موقفي في كل تعقب.
This paper addresses the jurisprudential annotations of Sheikh Ahmed Ibn Qasim Al ’Abadi on “Alsharh Alsagheer ‘ala Al-Waraqat” (The concise Explanation of Al-Waraqat Manuscript) by Sheikh Taj al-Din Alfazari (Al-Firkah). These annotations carry significance for specialists in the field of jurisprudential principles due to the esteemed scholars involved and the diversity of these annotations. The study concluded that the majority of these annotations are related to controversial viewpoints, rather than blatant errors. Some of these annotations go back to the commentator’ main interests, who is more inclined towards jurisprudence in his explanation of «Al-Waraqat,» while Al-’Abadi appears more concerned with theology. One of the findings is the prominence of the first explanation of the text amongst subsequent commentators. Many scholars benefited from it to elaborate on their explanations or rectify the opinions therein. Al-Fazari’s commentary is distinguished by presenting objections and counterarguments to the text. The number of these annotations reached eleven. Each annotation starts by pinpointing its location in the text, in addition to the commentator’s stance, then Al-’Abadi’s annotations, followed by my viewpoint on each annotation.
