المستخلص: تكتسي عملية المسح العام للأراضي أهمية كبيرة باعتبارها الأساس المادي لتأسيس السجل العقاري الذي يبنى على أساسه نظام الشهر العيني لينتج في الأخير الدفتر العقاري كبطاقة هوية للعقار الممسوح. غير أن الواقع العملي أظهر عدة إشكالات سايرت عملية المسح العقاري أهمها تلك المتعلقة بفوارق في المساحات بين تأشيرات الملكية والقياسات المساحية التي يقوم بها أعوان المسح، باعتبارها من أهم المنازعات المجسدة بالواقع والتي تثير عدة تعقيدات على الصعيد التطبيقي. الأمر الذي جعل المشرع الجزائري يتدخل لتنظيم هذه الإشكالات من خلال بعض التعليمات والمذكرات الداخلية الخاصة بالإدارات المعنية بعملية المسح العقاري.

The real estate survey process is of great importance because it is considered the basis for the establishment of the Land Registry with the aim of obtaining the real estate book, which is considered the identity card of the surveyed property. But the reality showed many problems that arose during the real estate survey process, the most important of which are those related to the existence of a difference in spaces between neighboring owners. This led the Algerian legislator to intervene to regulate these problems through some instructions and internal memoranda of the departments concerned with the process of surveying real estate.

Le processus d’arpentage immobilier est d’une grande importance car il est considéré comme la base de l’établissement du registre foncier dans le but d’obtenir le livre immobilier, qui est considéré comme la carte d’identité de la propriété arpentée. Mais la réalité a montré de nombreux problèmes qui se sont posés au cours du processus d’enquête immobilière, dont les plus importants sont ceux liés à l’existence d’une différence d’espaces entre les propriétaires voisins. Cela a conduit le législateur algérien à intervenir pour régler ces problèmes à travers quelques instructions et notes internes des départements concernés par le processus d’arpentage immobilier.
