يتناول هذا البحث موضوع الشروع في ارتكاب الجريمة تشريعا وفقها وقضاء، وحتى نستطيع الإحاطة بالأحكام التفصيلية المتعلقة بالشروع فقد تم تقسيم البحث إلى مبحثين، حيث تناولنا في المبحث الأول أركان الشروع، وبينا أن الشروع يقوم على ركنين: الركن المادي للشروع، والذي يقوم على عنصرين: أولهما البدء في التنفيذ، وقد أثار معيار البدء بالتنفيذ خلافا فقهيا حيث انقسموا إلى مذهبين: الأول المذهب المادي والثاني هو المذهب الشخصي. أما العنصر الثاني فهو عدم تحقق النتيجة الجرمية، وقد تكون صورة الشروع إما شروعا تاما أو شروعا ناقصا أو جريمة مستحيلة. أما الركن الثاني للشروع فهو الركن المعنوي. أما في المبحث الثاني تناولنا المساءلة الجزائية عن الشروع في الجريمة، حيث أوضحنا الجرائم التي يعاقب على الشروع فيها، ومن ثم بينا أن المشرع الأردني ميز بين عقوبة الشروع التام وعقوبة الشروع الناقص، كما أنه ميز بين العدول الاختياري في حالة الشروع الناقص عنه في حالة الشروع التام.
This research deals with the subject of the Initiation Legally, Jurisprudentially and Judiciary, and so that we can take the detailed Provisions relating to the initiation, therefore, the research is divided to two themes, as we dealt in the first theme in the basic elements of initiation, and we indicated that the initiation is based on two elements: The Material Element of Initiation, which is based on two components: The start of implementation, as the start of implementation standard has raised Jurisprudential difference, where they split to two ideologies: The first is the Material Ideology, and the second is the Personal Ideology. For the second component, it is the lack of verification of the criminal result; the form of initiation may be either full initiation, incomplete initiation or impossible crime. But for the second element of initiation, it is the Moral Element of initiation, it is the Moral Ideology,. In the second theme, we have dealt with the criminal accountability for the initiation of crime, and we explained the crimes punishable for the initiation, then we indicated that the Jordanian Legislator has distinguished between punishment of full initiation and the punishment of incomplete initiation.
