المستخلص: تناول هذا البحث بالدراسة فاعلية الاستصحاب عند الإمام ابن حزم ومنهجه الاجتهادي، وقد تكلم في المبحث الأول عن الاستصحاب، الذي يعد دليلا من الأدلة الشرعية، التي تثبت بها الأحكام الفقهية، فتكلم عن تعريف هذا المصطلح، وطريقة اعتداد الأصوليين به، كدليل شرعي قبل ابن حزم وبعده. وقد حاول البحث أن يلم بأنواع الاستصحاب عند ابن حزم كاستصحاب النص، المتمثل في استصحاب العموم، واستصحاب الخصوص، وكذلك استصحاب حكم الأصل، واستصحاب اليقين، واستصحاب العدم الأصلي. أما المبحث الثاني، فقد جاء في أربعة مطالب، تكلم عن منزلة العقل في المنهج الاستدلالي عند ابن حزم في المطلب الأول، وفي المطلب الثاني تكلم عن الظاهر عند ابن حزم، وتكلم في المطلب الثالث عن موقف ابن حزم من القياس، وفي المطلب الرابع تكلم عن موقف ابن حزم من التعليل الأصولي، ثم خاتمة في أهم النتائج والتوصيات. ونظرا لما لدليل الاستصحاب من أهمية بين الأدلة الشرعية المقررة عند الأصوليين؛ لا سيما ابن حزم الذي رفض كثيرا من الأدلة، التي يعتد بها غيره من الأصوليين: كالقياس، والتعليل وغيرهما. يأتي هذا البحث ليكشف لنا عن أهمية هذا الدليل عند ابن حزم، وكيف استطاع أن يوظفه توظيفا يوحي بسماحة الشريعة الإسلامية ومرونتها، واستعدادها للتعامل مع ما تستجد من حوادث، وما تطرأ من مشكلات، كما يكشف لنا أيضا عن بناء منهجه الاجتهادي، القائم على رفض القياس والتعليل، والإعلاء من شأن العقل، وكيف استطاع أن يجعل دليل الاستصحاب بديلا لما رفضه من أصول. ومما يسترعي الانتباه، أن منهج ابن حزم قد تبوأ مكانة واسعة، واحتل موقعا مؤثرا في التراث الفقهي، ومن أهم ما يميز فكر ابن حزم هو موقفه المناصر للعقل، مع عدم غفوله عن الاستدلال بالنص؛ الأمر الذي أكسب فقهه لونا خاصا ونكهة خاصة، ميزته عن فقه غيره، وجعلت له حضورا مؤثرا في عالم الفقه.

This research dealt with the study of the effectiveness of companionship with Imam Ibn Hazm and his diligent approach. In the first topic, he spoke about companionship, which is considered one of the legal evidences, by which jurisprudential rulings are established. He spoke about the definition of this term, and the way the fundamentalists relied on it, as a legal evidence before Ibn Hazm. And after him The research has tried to understand the types of companionship according to Ibn Hazm, such as the companionship of the text, which is represented in the companionship of the general, the companionship of the particular, as well as the companionship of the rule of origin, the companionship of certainty, and the companionship of the original nothingness. As for the second topic, it came in four demands. It talked about the status of the mind in the deductive approach of Ibn Hazm in the first requirement, and in the second topic he spoke about the apparent according to Ibn Hazm. In the third topic, he spoke about Ibn Hazm’s position on analogy, and in the fourth topic he spoke about Ibn Hazm's position on fundamentalist reasoning, then a conclusion in the most important findings and recommendations. In view of the importance of the evidence of companionship among the legal evidence established by the fundamentalists; Especially Ibn Hazm, who rejected many of the evidence that other fundamentalists relied on: such as analogy, reasoning, and others. This research comes to reveal to us the importance of this evidence for Ibn Hazm, and how he was able to employ it in a manner that suggests the tolerance and flexibility of Islamic law, and its willingness to deal with new incidents and problems that arise. And reasoning, and the exaltation of the mind, and how he was able to make the evidence of companionship an alternative to what he rejected from the origins. What draws attention is that the approach of Ibn Hazm has assumed a wide position, and occupied an influential position in the jurisprudential heritage. Which gave his jurisprudence a special color and flavor, which distinguished it from the jurisprudence of others, and made it an influential presence in the world of jurisprudence.
