|a يتناول هذا البحث مصدرا من مصادر التشريع المختلف في حجيتها، أعني "قول الصحابي" ورأي الإمام الشيرازي في مدى حجيته؛ وذلك من خلال أقواله الأصولية الوارد عنه في هذه المسألة، وأثره في اختياراته الفقهية من خلال كتاب الحدود في كتابه "المهذب في الفقه الشافعي". وقد قسمت البحث إلى تمهيد ومبحثين؛ التمهيد خصصته للتعريف بالإمام الشيرازي، وكتبه، ثم عرجت على مفهوم الحدود، وكذلك مفهوم الصحابي عند المحدثين والأصوليين، أما المبحث الأول فقد جعلته لبيان حجية قول الصحابي عند الإمام الشيرازي، وأقسام أقوال الصحابة ومدى حجيتها عند المذاهب المختلفة، وأما المبحث الثاني فقد عقدته لبيان أثر قول الصحابي في اختيارات الإمام الشيرازي في كتاب الحدود من كتابه "المهذب في الفقه الشافعي".
|b This research deals with one of the controversial sources of legislation in terms of its authoritativeness, i.e., "the saying of the Prophet's Companion" and the opinion of Imam Al-Shirazi as to the extent of its authoritativeness. The research explores this point through his fundamentalist sayings on this issue, and his impact on his jurisprudential choices in the section on “Al-„Hudud” (The limits or punishments ordained by Allah) in his book Al-Muhadhdhab fi Fiqh Al-Shafi'i. (The Refined in Shafi'i Jurisprudence). The research is divided into Introduction and two studies: Introduction is devoted to defining Imam Shirazi and his books; then I deal with the concept of hudud, as well as the concept of “the Prophet's companion” according to the hadith scholars and fundamentalists. The first section deals with authoritativeness of the saying of “the Prophet's companion” and the divisions of those sayings and their authority on the different factions. The second sections deals with the effect of “the Prophet's companion's saying on the choices of Imam Al-Shirazi in the section on “Al-Hudud” in his book Al-Muhadhdhab fi Fiqh Al-Shafi'i. (The Refined in Shafi'i Jurisprudence).
