المستخلص: تعتبر الخبرة الطبية القضائية وسيلة من وسائل الإثبات في قضايا الأسرة، يلجأ إليها من أجل كشف الأدلة، حيث سمح المشرع الجزائري للقاضي منه قاضي الأسرة سلوك طريق الخبرة القضائية ومنها الخبرة الطبية في المسائل الفنية التي تخرج عن المجال القانوني. والخبرة الطبية القضائية، يقوم بإنجازها الخبير الطبي، لكن هذا لا يعني أنه لا يد لقاضي الأسرة فيها، بل له دور رئيسي من بداية الخبرة إلى نهايتها، على أنه القلب المحرك، والعمود الفقري فيها، فيؤدي الخبير الطبي مهمته تحت سلطة، وإشراف القاضي الذي عينه.

L'expertise médicale judiciaire est considérée l’une des moyens de preuves juridique dans les affaires familiale, le législateur algérien a permet au juge ainsi au juge de la famille de recourir a l’expertise dans les questions techniques qui sont en dehors du domaine juridique. Ainsi que l’expertise médicale judiciaire est établie par l’expert médicaux, car le juge n’a pas la droit d’intervenir en imposant à l’expert comment chercher les points techniques ou de lui dicter une méthode, l’expert joui durent l accomplissement de sa mission de la liberté d’agir et de choisir les moyens artistiques qu’il juge appropriés. Cela ne veut toutefois pas dire que le juge de la famille n’a aucun pouvoir dans l’expertise médicale judiciaire, mais qu’ il a au rôle clé, positif et efficace du début à la fin de l’expertise, dont il est le coeur battent et la colonne vertébrale l’expert donc accomplit sa mission sous l autorité et la supervision du juge l’ayant commis et sous son contrôle.

Judicial medical expertise serves as a means of proof in family cases employed to uncover evidence. The Algerian legislator has granted the family judge the authority to pursue judicial expertise, including medical assessments, for technical issues beyond the scope of legal expertise. While the medical expert is responsible for conducting the judicial medical examination, it is essential to note that the family judge plays a significant role throughout the entire process. Acting as the driving force and backbone, the judge is actively involved from the initiation to the conclusion of the expertise.
