المستخلص: لقد حرصت الشريعة الإسلامية على حفظ الأنساب من الضياع أو الافتراء، ووضعت أحكاما لثبوت النسب، وجعلته حقا للولد ولأبويه وسائر القرابات، حتى تنشأ الأسرة على أسس قوية يجمع بين أفرادها صلة الدم والقرابة التي تقوي عزمها وتشد أزرها ليكون لها دورها الفعال في المجتمع، ولتثبت لها الحقوق وتلتزم بالواجبات الشرعية المتبادلة بين أفرادها. ونظرا لأهمية الموضوع ومنها اختلاط الأنساب لم تعترف الشريعة الإسلامية في موضوع النسب سوى بما ينتج عن الزواج الصحيح وجعله طريقا أصليا في ثبوت النسب، كما أقر الفقهاء بأن النسب يثبت أيضا بالإقرار أو بالبينة، وتطبيقا لهذا نص قانون الأسرة في المادة 40 على أنه: "يثبت النسب بالزواج الصحيح أو بالإقرار أو بالبينة أو بنكاح الشبهة أو بكل زواج تم فسخه بعد الدخول طبقا للمادة 32 و33 و34 من هذا القانون. يجوز للقاضي اللجوء إلى الطرق العلمية لإثبات النسب"، وقد ساير المشرع الجزائري ما توصل إليه العلم الحديث من استعمال التقنيات الجديدة المعاصرة؛ لإيجاد حلى لمعضلة عسر الإنجاب لدى عدد معتبر من الأزواج، فقرر اعتماد التلقيح الاصطناعي كطريقة من طرق إثبات النسب كلما توفرت الشروط المنصوص عليها في المادة 45 مكرر.
