المستخلص: تحتاج العملية الانتخابية إلى جهة تتولى إدارتها من حيث التحضير المادي لها والمتابعة الدقيقة لكافة مجرياتها ومراحلها، وحتى تتمكن هذه الأخيرة من أداء مهامها على أكمل وجه فانه ينبغي لها أن تكون متمتعة بقدر كبير من الصفات التي تجعلها أهلا لإدارة العملية الانتخابية بصورة شفافة ومن أهم هذه الصفات نذكر الحيادية. على اعتبار أن إدارة العملية الانتخابية قد تتم من قبل هيئة محايدة أو من قبل الحكومة القائمة أو من قبل المراقبين الدوليين فان السؤال الذي يطرح نفسه في هذا المقام يتمحور أساسا حول أي من هاته الهيئات أحيد من الأخرى في إدارتها للعملية الانتخابية؟ وماهي الضمانات التي تمت إحاطتها بها لضمان حياديتها؟ لقد جاءت دراستنا أساسا من اجل بيان أهم الهيئات المنوطة بإدارة العملية الانتخابية، وكذا الضمانات التي أحيطت بها من أجل ضمان حياديتها في إدارتها للعملية الانتخابية، سواء تعلق الأمر بالاستقلالية أو النزاهة أو الشفافية أو الإشراف والرقابة.

The electoral process needs to be managed by a body in terms of materials and careful follow-up for all its events and stages. This latter, to perform its functions to the fullest, it should possess a great deal of qualities and qualifications that make it eligible for the management of the electoral process in a neat and transparent way and the most important of these qualities we set the neutrality. Considering that the management of the election operation has been done by a neutral body or by an existing government or by international observers, the question that arises in this regard is centered mainly about any of these bodies is the most neutral in the management of the electoral process? And what are the guarantees that have been enclosed out to ensure its neutrality ?Our study comes mainly to show the most important bodies entrusted with the management of the electoral process, as well as the guarantees that is surrounded by in order to ensure its neutrality Whether the independence or the impartiality, the transparency or the supervision and the control.

Le processus électoral doit être géré en termes d’une préparation matérielle et un suivi minutieux de toutes ses étapes. Afin que ce dernier puisse remplir correctement ses fonctions, le processus électoral doit donc posséder de nombreuses qualités lui permettant de mener le processus électoral de manière transparente, et la neutralité est l’une de ces qualités les plus importantes. Et comme la gestion du processus electoral peut être menée par un organisme neutre, ou par le gouvernement existant ou même par des observateurs internationaux, la question qui se pose est laquelle parmi ces instances est la plus neutre pour gérer le processus électoral? Et quelles sont les garanties qui lui sont confiées pour assurer son impartialité? Notre étude consiste principalement de l’identification des organismes les plus importants chargés de gérer le processus électoral, ainsi que les garanties qui leur ont été confiées afin d’assurer leur neutralité dans la gestion du processus électoral, à savoir l’indépendance, l’intégrité, la transparence, la supervision ou le contrôle.
