المستخلص: إن المجتمع الدولي وإن كان قد قطع بعض الأشواط من أجل تكريس المسؤولية الدولية الجنائية عن الجرائم الدولية، إلا أن الطريق لا يزال طويلا للوصول إلى الزجر التام لهذا النوع الخطير من الإجرام، ذلك أن النظام القانوني للجزاء الدولي الجنائي لا يزال تعيقه كثير من الظروف التي تسود العالم وتقف حائلا بينه وبين الوصول إلى إقرار فكرة العدالة الدولية الجنائية؛ ولعل من أبرز هذه العوائق: العوائق المؤسسية والتنفيذية التي تثير إشكاليات قانونية عدة، وتمكن كثيرا من المجرمين الدوليين من الإفلات من العقاب، كما تمكن جهات معينة من الاستغلال السيء للعدالة الدولية الجنائية، وقد جاء هذا المقال الموسوم بـ " العوائق المؤسسية والتنفيذية للعدالة الدولية الجنائية ليعالج هذه القضية، مستعرضا قضيتين مهمتين، الأولى تتعلق بمدى شرعية الأجهزة القضائية الدولية الجنائية، والثانية عن كيفية تنفيذ الجزاء الدولي الجنائي.

Even though the international community has made some strides in order to set up the international criminal responsibility for international crimes, the road is still long to achieve full deterrence of this serious type of crime because of the impediment that caused by many conditions prevailing in the world that stand in the way of establishing the idea of international criminal justice. Perhaps one of these obstacles are the institutional and practical barriers that engender several legal dilemmas, enable many international criminals to escape from punishement and allow certain sides badly exploiting the international criminal justice. This article entitled: "Institutional and Practical Impediments to International Criminal Justice" addresses this problem out of two important issues: one concerning the legitimacy of international criminal judicial organs and the second on how implementing the international criminal sanction.

La communauté internationale a fait quelques progrès afin d'établir la responsabilité pénale internationale, pour les crimes internationaux, cependant, il reste encore un long chemin á accéder au refus complet de ce type dangereux de criminalité alors que le system juridique de la peine pénale internationale est entravé par la plupart des circonstancesqui prévalent dans le monde et se dressent entre lui et entre l'accès à la mise en place de l'idée de la justice pénale internationale, et peut être l'un des plus importants de ces obstacles: les obstacles institutionnels et opérationnels qui soulèvent plusieurs problèmes juridiques et de nombreux criminels internationaux ont été en mesure d'échapper à la punition, et cela permet également d'abuser de la justice pénale internationale. Cet articles est sous titre de: "les obstacles institutionnels et opérationnels de la justice pénale interationale" pour résoudre le problème en deux cas importants. Le premier concerne la légitimité du system du systeme de justice pénale internatioale et le second comment exécuter la pénalité pénale internationale.
