المستخلص: تشكل السياحة في الوقت الحاضر ظاهرة اجتماعية واقتصادية، وتعتبر ركيزة أساسية يقوم عليها أي اقتصاد وطني تأخذ تقديم خدماتها جهات حددها القانون تتمثل في وكالات السياحة والسفر، تهدف إلى تنظيم رحلات سياحية سواءا كانت فردية أو جماعية بموجب عقد الرحلة السياحية، الذي يرتب التزامات متقابلة على عاتق طرفيه- وكالة السياحة والسفر والسائح- ولعل أهم التزام يقع على عاتق الوكالة هو ضمان سلامة السائح وأمتعته، الذي يحتل مرتبة حدها الأعلى التزام بتحقيق نتيجة وحدها الأدنى التزام ببذل عناية من خلالها يذهب القضاء إلى تشديد مسؤولية الوكالة بضمان السلامة، وتخفيف عبء إثبات الضرر الحاصل على المضرور.

Tourism currently constitutes a social and economic phenomenon and is considered as the main pillar on witch the national economay is based, the services provided by the law are represented by the agencies of tourism and travel, so they organize trips, whethers individuel or collective, under a contract between the parties to satisfy but we find that the nature of the commitment of thies agencies to tourists varies from a commitment to careful attention and commitment to achieve a result. Accordingly, the Algerian tourist agencies still suffer from obstacles and difficulties in the demand for their tourist services. Therefor, they bear the civil responsibility for repressing the damage caused to tourists by providing maximum protection and security for them.

Le tourisme est à l’heure actuelle est un phénomène social et économique, est considérée comme la base essentielle sur laquelle les entités économie nationale, en prenant ses services définis par la loi sont des agences de tourisme et voyage, il organise des excursions, que ce soit individuel ou collectif, en vertu d’un contrat conclu entre les deux parties afin de satisfaire les besoins des touristes qui vont engagement à exercer une étroite, et engagement envers les soins en conséquences, a travers laquelle la justice renforce la responsabilité des agences touristiques et de voyage pour garantir la sécurité et l’allégement de la charge de preuve du tord sur le lésé.
