|a إن ارتباط التشريع بالمقاصد الأخلاقية هو ارتباط بالغ التوثق بما تمثله الأخلاق من مكانة في الدين الذي هو في غايته تخلق بالمكارم، تمثل الأخلاق فيه الوجه الجمالي للتشريع. وقد ابتدأ البحث بتأصيل المقاصد الأخلاقية للشريعة، من حيث مفهومها والسمات العامة لها، وعلاقتها بالمقاصد العامة، ثم ناقش التكامل الوظيفي بين الأحكام التشريعية والمقاصد الخلقية؛ وقد انتهج البحث منهج الاستقراء التحليلي لتقعيد أهم المقاصد الأخلاقية المؤثرة في التشريع، ونتيجة لهذا الاستقراء رأى أن أهم المقاصد الأخلاقية التشريعية في المجمل راجعة بالاستقراء إلى ثلاثة مقاصد كلية ناقشها البحث: المقصد الأول: قصد الشريعة إلى تحقق التخلق بمكارم الأخلاق؛ من خلال نظم القيم الأخلاقية في صيغ تشريعية، والمقصد الثاني: تحقيق فقه الإحسان في مقابل الضبط القضائي؛ من خلال دوران التشريع في المعاملات وحقوق العباد بين مرتبتي العدل والفضل، والواجب بالشرع والواجب بالمروءة، والمقصد الثالث: تحقق المكلف بالوازع الأخلاقي المؤدي إلى استقامة الظاهر والباطن، واعتبار القصود والبواعث. وقد تعرض البحث لبعض تطبيقات توظيف واستثمار هذه المقاصد في توجيه الفتوى على بعض النوازل المعاصرة.
|b The association of legislation with moral objectives is a great one. This association is represented in the status of ethics in religion, whose one of its aims is represented in nobility, and whose one of its aesthetic aspects is the concept of morals. This research begins with founding out the moral ethics of Sharia, i.e., its concept, its general features, and its status as well as objectives. The research discusses the contemporary renewal trend of studying the moral objectives of legislation. The research also approaches the integration between legislative provisions and moral objectives, in a sense that the moral objectives are taken into consideration in establishing the jurisprudence of moral objectives. In return, the jurisprudence provisions provide a task of pinpointing the moral aspects, supplying and preserving morals, and formulating moral values in a legislative form. The research attempts to formulate the most important moral objectives within the framework of this legislative task of ethics. It also points out that the most important task of the legislative moral objectives in general is the extrapolation of the following three objectives. The first objective: achieving an adoption of morals and beautification of virility and human dignity, and admitting this in the deduction of provisions. The second objective: considering legislation in transactions and peoples' rights is constant between justice and virtue, the duty of Sharia and the duty of nobility, and achieving the jurisprudence of charity. The third objective: achieving the moral motivation on the approval of the Sharia in intention and motivations, as well as in the apparent and the inner. The research concludes with some applications of employment and investing these objectives in directing the fatwa in some contemporary issues.
