المستخلص: يتناول هذا المقال بالشرح والتحليل الدولة الليبية الجديدة انطلاقا من البحث عن شكل سياسي جديد لها، في وقت أصبحت الحاجة إلى إقامة دولة في ليبيا بمؤسسات موحدة أمرا ملحا، وليس مجرد نقاش فلسفي نخبوي عام، وذلك من خلال دراسة العوامل الجوهرية التي ساهمت في تبلورها، والتي من أبرزها، اندلاع الثورة الشعبية، من خلال عرض المعاني المفاهيمية والأسس النظرية لها، والبحث كذلك في مفهوم الثورة من وجهة النظر القانونية، وكذا السياق الاجتماعي الثقافي لها أيضا، هذا فضلا عن الحديث عن سوسيولوجيا الثورة الليبية، والأسباب الرئيسية وراء اندلاعها، سواء الأسباب الداخلية، أو الخارجية منها والتي أفرزها ما يسمى بسياق "الربيع العربي"، بالإضافة إلى بحث أسس الثورة وأهدافها الأساسية، وكذلك حصيلة الثورة الليبية، إلى جانب الإشارة كذلك إلى نهاية نظام القذافي، من حيث اعتبار الثورة وسيلة لتدمير دعائم نظامه الجماهيري، وانهيار للنظام السلطوي في البلاد، إضافة إلى دراسة التحول السياسي في ليبيا والانتقال نحو نظام ديمقراطي جديد، وما يواجه ذلك من تحديات استثنائية، وكذا الحديث عن المرحلة الانتقالية الصعبة بعد الثورة، وذلك من خلال تسليط الضوء على الصعوبات والعقبات التي تواجه تلك المرحلة، إضافة أيضا إلى الحديث عن مسالة الدستور الليبي الجديد، انطلاقا من الدعوة إلى صياغة الدستور، والموازنة بين فرص تحقيقه والتحفظات التي تثار حوله، فضلا عن الحديث عن الشرعية المتنازع عليها وغير المحققة في ليبيا، والقوى المتعددة التي تدعي امتلاكها للشرعية، وأخيرا دراسة قضية الدستور الليبي المنتظر، وتعليق التصديق عليه وتأجيل قبوله.

This article discusses the explanation and analysis of the new Libyan state based on the search for a new political form, at a time when the need to establish a state in Libya with institutions has become a matter of urgency and not just a general philosophical elitist debate. This can be done through the study of the fundamental factors that have contributed to the materialization, the most important of which is the bursting of the popular revolution; through the presentation of the meanings of conceptual theory and its foundations, and the search for the concept of revolution from the legal point of view, as well as the socio-cultural context. We must also speak about the sociology of the Libyan revolution, and the main reasons for its eruption. Internal reasons and external factors appeared in the so-called "Arab Spring" context, in addition to questions about the foundations of the revolution and its fundamental objectives, the outcome of the revolution that signed the end of the Gaddafi regime as a means to destroy the foundations of its mass system, the authoritarian system prevailing in the country. The study also focuses on the political transition in Libya with the goal of moving towards a new democratic system, which faces exceptional challenges. A transition that proves difficult after the revolution and talking about it requires highlighting the difficulties and obstacles encountered. There is also the question of the constitution of the new Libya, on the basis of the modalities of its drafting and the balance between the challenges to be reached and the reservations raised on this subject. In the same way as the disputed and unrealized legitimacy in Libya and the multiple forces that all claim to have legitimacy must be addressed. Finally study the question of the expected Libyan constitution, in terms of suspension of its ratification and the postponement of its acceptance.

Cet article traite de l'explication et de l'analyse du nouvel Etat libyen basé sur la recherche d'une nouvelle forme politique, à un moment où la nécessité d'établir un Etat en Libye avec des institutions est devenue une question d'urgence et non seulement un débat élitiste philosophique général. Cela pourra se faire à travers l'étude des facteurs fondamentaux qui ont contribué à la matérialisation, dont le plus important est l'éclatement de la révolution populaire ; à travers la présentation des significations de la théorie conceptuelle et ses fondements, et de la recherche du concept de la révolution du point de vue juridique, ainsi que du contexte socioculturel. Il faut aussi parler de la sociologie de la révolution libyenne, et des principales raisons de son éruption. Des raisons internes et des facteurs externes sont apparus dans le contexte dénommé « Printemps arabe », outre des questions surles fondements de la révolution et de ses objectifs fondamentaux, l'issue de cette révolution qui a signé la fin du régime de Kadhafi comme un moyen de détruire les fondements de son système de masse, du système autoritaire régnant dans le pays. L'étude porte aussi sur la transition politique en Libye avec l’objectif d’aller vers un nouveau système démocratique, requérant de faire face à des défis exceptionnels. Une transition qui s’avère difficile après la révolution, et en parler nécessite de mettre en lumière les difficultés et les obstacles rencontrés. Se pose également la question de la constitution de la nouvelle Libye, sur la base des modalités de sa rédaction et l'équilibre entre les défis à atteindre et les réserves soulevées à ce sujet. De même que doivent être abordées la légitimité contestée et non réalisée en Libye et les forces multiples qui prétendent toutes être investies de légitimité. Enfin étudier la question de la constitution libyenne attendue, en termes de suspension de sa ratification et du report de son acceptation.
