|a لا شك أن مسألة الحصانات الممنوحة لرؤوساء أو زعماء الدول سواء على الصعيد الدولي أو على الصعيد الوطني تثير إشكالات عديدة عند وقوع الواقعة واتهام أو ملاحقة أحد الزعماء بجرائم دولية. هذه الحصانات المتمثلة بعدم مسؤولية الزعماء عن الجرائم التي يرتكبوها تصادم بالمحاكم الجنائية الدولية، لا سيما أن المحكمة الجنائية الدائمة في لا هي والتي ينص نظام روما التي أنشأها على عدم الاعتراف بالحصانات أمامها، بالتالي، إذا لوحق أحد زعماء الدول بإحدى الجرائم الدولية التي تدخل ضمن اختصاص المحكمة الجنائية الدولية سيرى نفسه مجردا من أي حصانة، هذا جانب من المشكلة. والجانب الآخر يتمثل بإشكالية تحديد الجهة التي تملك صلاحية رفع الحصانة عن الزعيم كي يساق ليحاكم أمام المحاكم الجنائية الدائمة لاسيما تلك الحصانات الممنوحة له بموجب التشريعات الوطنية، وهو لا يزال يمارس صلاحياته كرئيس لتلك الدولة. هذه الإشكالات التي حاولت هذه الدراسة أن تتلمس حلولا لها.
|b There is no doubt that the immunities granted to president or to the countries leaders at the international or the national level creates many problems when the event takes place and accusing or following one of the leaders for international crimes. These immunities represent in the leaders irresponsibility for the crimes they commit clash with the international criminal courts, especially that the permanent criminal court is in Lahai, which Rome system texts which established it does not recognize the immunities in front of it, if one of the country’s leaders tracked for one of the international crimes which inter in the specialty of the international criminal court, he will see himself deprived from any immunity, this is part of the problem. The other side of the problem represent by the problem determining the party which has the authority to eliminate the immunity from the leader to bring him to justice in front of the permanent criminal courts, especially these immunities granted to him according to national legislations, while he is still practicing his authorities as president of that state. These problems that this study attempted to find solutions for them.
