|a شهدت النزاعات المسلحة بنوعيها الدولية وغير الدولية تطورا ملحوظا مع الحقبات التاريخية التي مرت بها البشرية فمنذ القدم ولحد وقت ليس بالبعيد كان الاهتمام التشريعي والسياسي منصبا على النزاعات المسلحة الدولية دون غير الدولية، مما أحدث تداخلا كبيرا بين مفهوميهما وانعكس ذلك سلبا على عملية التمييز بينهما وعلى الضمانات التي تتمتع بها النزاعات المسلحة غير الدولية. وبسبب تفشي هذا النوع من النزاعات في دول العالم بشكل كبير بدأ المجتمع الدولي يوليها بعض الاهتمام وقد ازداد هذا الاهتمام مع التطور المقلق الذي حدث في ساحة النزاعات المسلحة غير الدولية، والذي تمثل في تدخل بعض الدول (صاحبة السلطة والقدرة) في النزاعات التي تشهدها دولا أخرى ودعمها للمجموعات المسلحة فيها أو لحركات التمرد المسلحة فيها مما أدى إلى تأزم وتعقد في مفهوم هذا النوع من النزاعات المسلحة وعملية التمييز بينها فأفرز أنماطا لاهي غير دولية ولا هي دولية.
|b Armed conflicts of both types, international and non international, have witnessed a remarkable development with the historical eras that humanity has gone through. Since ancient times, until not long ago, the legislative and political attention had focused on international armed conflicts rather than non-international ones, which caused a great overlap between their concepts, and this negatively affected the process of distinguishing between them and the guarantees enjoyed by non international armed conflicts. Because of the large spread of this type of conflict in the countries of the world, the international community began to pay some attention to it, and this interest increased with the disturbing development that occurred in the arena of non-international armed conflicts, which was represented in the interference of some countries (who have power and ability) in the conflicts taking place in other countries. And its support for the armed groups in it or the armed rebellion movements in it, which led to a crisis and complexity in the concept of this type of armed conflict and the process of distinguishing between them, so it produced patterns that are neither international nor international.
