|a يهدف البحث إلى التعريف بالأمر، وبيان ما تقتضيه دلالة الأمر المطلق، وإيضاح إعمال الفقهاء لها في نصوص السنة، وأثر القرينة في صرفها عن الوجوب إلى الإباحة أو الندب. وتم تقسيمه إلى قسمين: القسم الأول عبارة عن دراسة أصولية لقاعدة اقتضاء الأمر الوجوب، وذكر المذاهب فيها، مع أدلتها ومناقشاتها. والقسم الثاني تطبيق لقاعدة اقتضاء الأمر الوجوب على الأوامر التي اشتملت عليها أحاديث أبواب الطهارة من كتاب "منار السبيل"، وقسمت الأوامر إلى ثلاثة مباحث حسب دلالتها عند المؤلف على الوجوب أو الإباحة أو الندب، مع ذكر الصارف للحكم عن الوجوب إلى الإباحة أو الندب. وفي الأوامر الدالة على الوجوب أذكر في الغالب الصارف الذي استند إليه الرأي المخالف في المسألة. وتبين من خلال البحث أهمية مثل هذه الدراسة التطبيقية على أحاديث الكتاب.
|b This study aims to define the concept of command and clarify the implications of absolute command in the texts of Sunnah, highlighting how jurists apply the concept in the texts, as well as the influence of contextual indicators in redirecting the understanding of obligation towards permissibility or recommendation. The study is divided into two sections. The first section offers an Islamic jurisprudential study of the principle of obligation in command, presenting the different schools of thought, their evidence, and discussions. The second section deals with the application of the principle of obligation in command to the commands mentioned in the hadiths of the chapters of purification from the book "Manar al-Sabeel." The commands are categorized into three sections based on the author's understanding of their implications as obligation, permissibility, or recommendation. The study also mentions the factors that lead to the deviation of the ruling from obligation to permissibility or recommendation. In the commands indicating obligation, the opposing opinions on the matter are also mentioned, along with the evidence they rely on.
