|a إن ديننا الإسلامي الحنيف، عرف بمواكبته لكل عصر في تطوراته ومستجداته، مما يدل على أنه مصلح لكل مكان وزمان، وفي عصرنا الحديث، برزت قضايا مستجدة في نواحي الحياة، بسبب التقدم التكنولوجي الهائل؛ وبسببه ظهرت قضايا فقهية وطبية معاصرة، وبالتحديد قضية المغير جنسه وما ترتب عليها من آثار متعلقة بالنكاح والإرث وغيرهما وحديثنا في هذا البحث حول نكاح المغير جنسه والآثار المترتبة عليه. وبيان حكم الشرع في نكاح المغير جنسه مشتملا على جملة من آراء العلماء القدامى والمعاصرين، خاتما هذا البحث بجملة من النتائج. وعليه فقد قسمت البحث على النحو التالي أو لا ماهية تغيير الجنس وأنواعه وحكم نكاح المغير جنسه والآثار المترتبة على نكاح المغير جنسه.
|b Our upright religion of Islam is well known to be very recognizing of all developments and discoveries along the history, that is because Islam is suitable for all places and all times. In our current era, there were some new issues in life which have developed because of the huge advancement of technology. As such, many current Fiqhi and medical issues have been recognized and needed to be addressed, particularly, the issue of changing sex gender and what it will lead to a certain ramifications and issues related to marriage, inheritance, and other issues. And our conversation on this topic is about the ruling on marrying a transgender person and its implications. In this assay, the Shari'a rules of his/her marriage will be explained and the opinions of the current scholars in this matter will be outlined, and the assay will end with a series of conclusions. Therefore, I have divided the topic as following: First: what is gender change, how many types, the Shari'a rules on his/her marriage and what are the ramifications and issues developed of those who will do so.
