|a يعتبر عقد الامتياز النموذج الأكثر انتشارا في مجال إشراك القطاع الخاص في تسيير المرافق العمومية، خاصة وأن هذه التقنية تخفف العبء على الدولة من خلال تحمل الملتزم تكاليف تسيير المرفق العمومي واستغلاله من جهة، وإشباع الحاجات العامة بجودة وكفاءة من جهة أخرى، وإن كانت سلطة الملتزم في تسيير المرفق العمومي ليست مطلقة، بل يبقى هذا الأخير خاضع لسلطة الإدارة، ورقابتها، حتى لا يحيد الملتزم عن مقتضيات المصلحة العامة. حيث تسهر الإدارة على التوفيق بين مصلحتها ومصلحة المتعاقد معها باعتماد عدة معايير تساهم في إنجاح هذه التقنية.
