|a إن التطور العلمي الحديث سمح بالبحث عن سبل الشفاء إلى أن توصل إلى إمكانية نقل الأعضاء الآدمية في حالة ما استعصى الشفاء بالمواد الصيدلانية والتدخلات الجراحية، وقد يتسبب نقل وزرع عضو آدمي في إصابات بليغة قد تودي بحياة المريض، وبذلك فإن التشديد في الحماية القانونية المفروضة على العناصر والمنتجات المشتقة من جسم الأنسان وما يرد عليه من ممارسات طبية وعلمية من شأنها المساس بتكامله، يفسرها مبدأ حرمة الكيان الجسدي للإنسان. إن هذه الخصوصية امتدت إلى نظام المسؤولية، جعلت التشريع الحديث يتجه إلى عدم الإعفاء من المسؤولية ومن في حكمه كالناقل والمكلف بالحفظ لأي عنصر من عناصر جسم الإنسان أو المنتجات المشتقة منه، حتى ولم يكن في وسعه الكشف عن العيب بسبب قصور المعرفة العلمية والفنية أو ما يسمى بمخاطر التطور العلمي.

This specificity extended to the liability system, which made modern legislation tend to not exempt from liability and those in the same category, such as the transporter and the one charged with preserving any element of the human body or products derived from it, even if he was not able to detect the defect due to the lack of scientific and technical knowledge or the so-called dangers of scientific development.
