|a السياسة الشرعية هي تدبير شؤون الأمة بما يصلحهم، وقد طبق ذلك قانون التنفيذ الشرعي، ومن السياسة الشرعية الحبس للامتناع عن تنفيذ الحق أو إرجاعه لصاحبه في قضايا المشاهدة والاصطحاب والمبيت، أو وقف تنفيذه، وقد أخذ قانون التنفيذ الشرعي بذلك، وأكثر التطبيقات السياسة المستعملة في القانون هو منع التعسف، وقواعد دفع الضرر ومنعه، وقد طبقت لمنع أي تعسف في استعمال الحق، ودفع الضرر قدر الاستطاعة إذا كان واقعا أو متوقعا على أحد من أطراف التنفيذ.
|b The legitimate policy is managing the nation’s affairs in away that works for them. This has been implemented by the law of legitimate execution and among the legitimate policy is imprisonment for refraining from implementing the right or returning it to its owners in cases of witnessing, accompanying and staying overnight or stopping it’s implementation. The legitimate execution law has taken this and the most political applications used in the law are the prevention of arbitriness and the rules for paying and preventing harm. It has been implemented to prevent any abuse of the right and to pay the damage as much as possible if it is occurred or foreseen by one of the parties to the implementation
