|a موضوع الدراسة: استخراج منهج القاضي أبي يعلى التحليلي من خلال كتاب الجراح، من كتاب الروايتين والوجهين. الهدف من البحث: إبراز طريقة القاضي أبي يعلى في تحليله لنصوص الإمام أحمد، وجمع تلك الطرق، مع التمثيل لكل طريقة. البحث يتكون من تمهيد: عرفت فيه بمفردات البحث، ثم عقبت بثلاثة مباحث، المبحث الأول: المسلك الأول: التفسير، وتحته سبعة مطالب، والمبحث الثاني: المسلك الثاني: النقد، وتحته ثلاثة مطالب، والمبحث الثالث: المسلك الثالث: الاستنباط، وفيه خمسة مطالب. منهج البحث: سلكت في هذا البحث المنهج الاستقرائي للروايات الواردة في كتاب الجراح من كتاب الروايتين والوجهين، ودراستها دراسة تفصيلية، ثم انتخبت الأمثلة على مسالك التحليل. الخاتمة فيها أهم نتائج البحث، والتوصيات. من أهم النتائج: ۱) ظهور النفس الاجتهادي النقدي للقاضي في كتاب الروايتين والوجهين من حيث تعامله مع نصوص الإمام، واستخراج ما وراء الألفاظ من علل وحكم ومآلات ومقاصد. ۲) كتاب الروايتين والوجهين من الكتب الفقهية التي تنمي الملكة الفقهية لدى المتفقه وتساهم في توسيع مداركه، وتساعد على استثمار علم أصول الفقه في التعامل مع النصوص الفقهية. ۳) أن القاضي له عناية بالتقعيد الفقهي، وذلك بذكر الضوابط الفقهية، والقواعد الكلية.
|b Study topic: Extracting the analytical approach of Alqadi Abi Ya’la through the book Al-Jarrah, from the book The two novels and the two sides. The aim of the research: Highlighting the method of Alqadi Abi Ya’la in his analysis of the texts of Imam Ahmad, and collecting those methods, with representation for each method. The research consists of a preamble: in which the definition of the research reasoning, followed by three sections, the first topic: the first track: interpretation, and below it are seven demands, and the second topic: the second track: criticism, and below it are three demands, and the third topic: the third track: deduction, and it has five demands. Research Methodology: In this research, I followed the inductive approach of the novels contained in the book of Al-Jarrah from the book of Two Novels and Two Faces, and I reviewed them in detail, then I chose the examples of the paths of analysis. Conclusion: It contains the most important research results. Recommendations: Among the most important results: 1) The emergence of the judge’s critical judgmental self in the book Al-Rawaitain and Al-Wajhain in terms of his dealings with the texts of the imam, and extracting what is behind the words of ills, wisdom and purposes. 2) The Book of the Two Narratives and Two Faces is one of the Farqih books that develop the Farqih faculty among the dispersed, and contribute to Expanding his understanding, and helping to invest the science of the origins of the sect in dealing with the sectarian texts.
