المستخلص: Throught This study , we will try to know if this right constitues a basis in our country, than constributing to have a modern and Civic administration which responds responsibility and transparency by asking what extent national legislation has been able to reconcile the principles of rule and exception to guarantee the rights for the individual and group, drawing by the important comparative experiences in this aspect, and adopting the legal approach to highlight weaknesses and imbalances in order to develop legislative texts and adapt them.
