|a عرفت الجزائر نظام الوقف حين اعتناقهم الإسلام دينا وعقيدة، وبعد الاستقلال أكدت الاعتراف رسميا بنظام الوقف، ولمعرفة تطور هذا النظام خلال الفترة الممتدة من القرن السابع على غاية استقلال الجزائر، تناولنا في المبحث الأول نظام الوقف بالجزائر منذ دخول الإسلام إلى شمال إفريقيا على يد الفاتح عقبة بن نافع، إلى غاية مجيء العثمانيين خلال المدة التي مكثوا بها في الجزائر والممتدة من 1516 إلى غاية 1830، وخصصنا المبحث الثاني لنظام الوقف إبان الاحتلال الفرنسي خلال الفترة الممتدة من 1830 إلى غاية 1962. حيث وقفنا على أنه شهد نظام الوقف مكانة مرموقة وازدهارا في مرحلة الحكم الإسلامي، وتعرض لانتهاكات وهدم لأركانه والاستيلاء عليه في مرحلة الاستعمار.
|b Algeria knew the waqf system when they embraced Islam as a religion and belief, and after independence confirmed the official recognition of the waqf system, and to know the development of this system during the period extending from the seventh century to the independence of Algeria, we dealt in the first section with the waqf system before the French colonialism, where we talked about the waqf in Algeria since the entry of Islam to North Africa by the conqueror Uqba bin Nafi, and then after the advent of the Ottomans during the period they stayed in Algeria and extended from 1516 to 1830, and We devoted the second section to the waqf system during the French occupation during the period from 1830 to 1962. Where we found that the waqf system witnessed a prominent and prosperous position during the Islamic rule, and was subjected to violations, demolition of its pillars and seizure in the colonial phase.
