لا شك في أن الوقف من أهم وأروع النظم الاقتصادية التي يستحق أن يفتخر بها المسلمون، وقد أدى على مر العصور رسالة عظيمة في مختلف الجوانب الاجتماعية في حضارتنا الإسلامية، بحيث لم تخل بقعة إسلامية من أوقاف جرى حبسها من أجل المصالح العامة والرقي بالمجتمع، لكن ما يؤسف له أن شأنه ورسالته في تراجع مستمر، بحيث لا نبالغ إن قلنا: هناك عشرات آلاف من المسلمين لا يعرفون شيئا عن الوقف بل لم يسمعوا به! ومما زاد الطين بلة ضعف الالتزام بالشريعة الإسلامية في بعض الدول المسلمة، ومن هنا استحسنت دراسة حال الوقف في كردستان العراق وبيان مشكلاته الإدارية واقتراح حلول لها، مبتدئا ببعض المقدمات والممهدات ذات الصلة بالوقف ورسالته في الحضارة الإسلامية، مقسما البحث على مبحثين للخوض في الجانبين المذكورين، معتمدا على المنهج الوصفي الاستنباطي للجانب النظري، والمقابلات الشخصية للجانب الميداني.
There is no doubt that endowment (Waqf) is one of the most important economic systems that Muslims should be proud of. It has played a significant role throughout the ages in various social aspects of our Islamic civilization. Virtually no Islamic region has been devoid of endowments that were dedicated for the public good and the advancement of society in various aspects. Unfortunately, what is regrettable is that its status and role are continuously diminishing. It wouldn't be an exaggeration to say that there are tens of thousands of Muslims who know nothing about endowments and have never even heard of it.! What exacerbates the situation is the weakness compliance to Islamic Sharia in some Muslim countries. Therefore, it is essential to study the state of endowments in Iraqi Kurdistan, highlighting their administrative problems and proposing solutions. The study begins with some introductory and background information about endowments and their role in Islamic civilization. The research is divided into two sections to delve into the theoretical and field aspects, relying on the descriptive-inductive approach for the theoretical aspect and personal interviews for the field aspect.
