الحلي (إجارته، وإعارته، ووقفه) الحمد لله وحده والصلاة والسلام على من لا نبي بعده. فإِنَّ الله جل قد أمر بالإحسان إلى الخلق ونفعهم، فقال له: ﴿وَأَحْسِنُوا إِنَّ اللَّهَ يُحِبُّ الْمُحْسِنِينَ﴾ [البقرة: ١٩٥]. ومن صور الإحسان الصدقة، والقرض، والإعارة، والوقف، وغيرها. والحلي مما يُعارُ ويُوقَفُ، وتحتاجه المرأة للزينة، وإعارته ووقفه من باب الإحسان. وقد تعطيه لغيرها بمقابل على جهة الإجارة. فهذه ثلاث مسائل في الحلي سأتناولها في هذا البحث بإذن الله، وهي: إجارة الحلي، وإعارته، ووقفه، وكذا بيان حكم الزكاة فيها. أما إجارة الحلي فقد اختلف العلماء الله في حكم ذلك، والراجح - والله أعلم - جواز الإجارة سواء أكانت الأجرة من جنس الحلي - الذهب أو الفضة - أم من غير جنسه، كما تجب الزكاة في الحليّ المؤجر على القول الراجح. وأما الحليّ فتجوز إعارته ووقفه على الراجح، ولا تجب الزكاة في الموقوف. والله أسأل أن ينفعنا جميعًا، ويرزقنا الصدق فيما نأتي ونذر
Praise be to Allah alone, and peace and blessings be upon the Prophet Muhammad, the last prophet. Indeed, Allah, the Almighty, has commanded us to show kindness to his creation and benefit them. He said, “And be benefactors, God loves benefactors.” [Quran, Al-Baqarah: 195] One form of kindness is giving charity, lending, loaning, endowing, and others. The Jewellery is among what is lent and endowed, and women need it for adornment, and lending and endowing it as acts benefact. It can also be given to others in exchange for compensation, like renting. In this research, with the permission of Allah, I will address three issues related to jewellery: leasing jewellery, loaning it, endowing it, and explaining the ruling on Zakat regarding it. Regarding leasing jewellery, scholars – My God Almighty have mercy on them, have differed in their opinions, and the most likely, God knows, is that leasing is permissible, whether the rent is in the form of the same type of jewellery (gold or silver) or a different type. Additionally, it is obligatory to pay Zakat on leased jewellery, according to the most likely opinion. As for loaning and endowing jewellery, it is permissible, most likely, and Zakat is not obligatory on endowed jewellery. I ask Allah to benefit us all, grant us sincerity in our actions and intentions, and may Allah’s blessings and peace be upon our Prophet Muhammad and his family and companions.
