|a أدى تدهور الأوساط العمرانية والبيئية من انتشار المباني الفوضوية على ضفاف المدن والوديان وتعدي على المناطق الطبيعية خاصة الأراضي الفلاحية إلى استنزاف الموارد الطبيعية المتاحة والطاقة، وفقدان المدن مظهرها الجمالي ورونقها، كما ساهم في تلوث البيئة الخارجية والداخلية للمباني لذا كان لزاما على المشرع الجزائري مواجهة الوضع القائم فأخذ من المخطط التوجيهي للتهيئة والتعمير في إطار لامركزية التخطيط الآلية القانونية التنظيمية المناسبة لتدارك الأمر بتحديد قواعد استعمالات الأراضي والبناء قصد تحقيق التوازن بين الحق في النشاط العمراني وضبطه وتوجيهه وبين الحق في بيئة سليمة، وبالنتيجة خلق بيئة عمرانية صحية آمنة ومستقرة في الوسط الحضري تلبي حاجيات السكان في الحاضر والمستقبل.
|b The deterioration of the urban setting and environment, namely: the spread of chaotic buildings on boards of cities and bank of valleys, affecting natural areas, especially agricultural lands, and so on, has led to depletion of available natural resources and energy, the loss of cities as to their aesthetic appearance and splendour, and the pollution by the way of the external and internal environment of buildings. Therefore, it became incumbent to the Algerian legislator to confront the current situation, starting from adopting orientation plan of development and urbanization within the framework of decentralized planning and the national policy for sustainable expansion and development of the territory, an appropriate legal, regulatory and control mechanism is established for correction, especially, by setting up rules for land and construction uses in order to concretize the balance between the right in urban activity, its control and orientation, from one hand, and the right to a healthy environment on the other. Consequently, it would be created in the urban area a healthy, secure and stable urban environment meeting the needs of the population now and in the future.
