المستخلص: تناولت هذه الدراسة المسؤولية الجنائية عن الإضرار بالمدنيين في الحرب في الفقه الإسلامي، هادفة إلي بيان رأيه فيها، وقد وقف الباحث على ماهية المسؤولية والكمين وعناصرهما وموقف الفقه الإسلامي منهما، فتبين أن القيام بالكمين في الحرب من الأعمال الجائزة والمشروعة فيها، وبأن قواعد الشريعة الإسلامية ومقاصدها العامة تقضي بمساءلة المتسبب بالإضرار بأرواح المدنيين من خلال نظام الديات وفق حالات معينة يجب معرفتها ومراعاتها.

Prisoners' release has always been a demand that all nations call for especially the Muslim nation which gives this issue a priority since releasing prisoners is closely associated with Islamic doctrine and Shari'a. Nowadays, Muslims form the biggest number of prisoners and their number in Palestine is seven thousand. Consequently, releasing Muslim prisoners by all means and approaches has been assured for its importance. This research deals with the Islamic approach in releasing detainees. It consists of an introduction, three chapters, and a conclusion and recommendations. In the introduction, the research importance, objectives, plans and previous studies have been presented. Also, the merit of resistance (Jihad) has been explained since imprisonment is one of its results. The definition of the prisoner and the importance of releasing him/her have been discussed as well. Chapter two has been devoted to the scholars' viewpoints on the judgment of prisoners' release showing their evidences that support these views. Chapter three discusses ways of releasing prisoners.The results of the study have appeared in the conclusion followed by the research 's important recommendations. \
