|a اهتم البحث بموضوع الحماية الإدارية للبيئة في النظام السعودي، وقياس مدى كفاية الأجهزة والأنظمة الإدارية في ضبط الأنشطة المتعلقة بحماية البيئة وتقييم الطرق والوسائل الوقائية والعلاجية المسنونة لذلك، سالكا المنهجين الوصفي والتحليلي لوصف ورصد الأنظمة والقواعد واللوائح المتعلقة بذلك مع تحليلها تحليلا علميا لتحقيق الأهداف المنشودة من البحث. وقد عرج البحث إلى بيان مفهوم الحماية الإدارية للبيئة، كما سلط الضوء على مواطن الحماية الإدارية للبيئة في المملكة العربية السعودية والتي تتنوع ما بين أنظمة قانونية تشريعية، وجهات وزارية وإدارية مختصة بتطبيق ومراعاة هذه الأنظمة. فمن النوع الأول: نظام الهيئة السعودية للحياة الفطرية، ونظام صيد الحيوانات والطيور البرية، ونظام الاتجار بالكائنات الفطرية المهددة بالانقراض ومنتجاتها، والنظام العام للبيئة، ونظام المراعي والغابات، ونظام المناطق المحمية للحياة الفطرية. ومن النوع الثاني: وزارة البيئة والمياه والزراعة، ووزارة الشؤون البلدية والقروية، ووزارة الاقتصاد والتخطيط، والرئاسة العامة للأرصاد وحماية البيئة، والمركز الوطني للالتزام البيئي. وخصص الباحث المبحث الثالث لبيان وسائل الحماية الإدارية للبيئة، وجعلها على نوعين: وسائل وقائية: كالحظر، والترخيص، والإخطار عن النشاط، ووسائل علاجية: كسحب الترخيص، ووقف العمل، وإعادة التأهيل ودفع التعويضات، والغرامة، والمصادرة، والسجن.
|b The research focused on the subject of administrative protection of the environment in the Saudi law, and measuring the adequacy of administrative tools and laws in controlling activities related to environmental protection and evaluating the preventive and corrective methods and means established for this. By following the descriptive and analytical approaches to describe and monitor the laws, rules and regulations related to this, while analyzing them scientifically to achieve the desired goals of the research. The research started with clarifying the concept of administrative protection of the environment, and shed light on the areas of administrative protection of the environment in the Kingdom of Saudi Arabia, which vary between legislative legal systems, and ministerial and administrative bodies specialized in implementing and observing these laws. Of the first type: the Saudi Wildlife Authority Law, the Wild Animals and Birds Hunting Laws, the Endangered Wildlife Species and Their Products Trafficking Law, the General Law for the Environment, the Pastures And Forestry Law, and The Conservative Wildlife Law. Of the second type: the Ministry of Environment, Water and Agriculture, the Ministry of Municipal and Rural Affairs, the Ministry of Economy and Planning, the General Presidency of Meteorology and Environmental Protection, and the National Center for Environmental Commitment. The researcher devoted the third section to explaining the means of administrative protection of the environment, and divided them into two types: Preventive means: such as ban, licensing, and warning of the activity, and Corrective means: such as withdrawing the license, stopping work, rehabilitation, paying compensation, fine, confiscation, and imprisonment.
