|a تتحدث هذه الدراسة عن النظام القانوني لعمليات حفظ السلام من خلال الوقوف على إطار القانوني الذي يؤطرها، حيث تعد مسألة الطبيعة القانونية لعمليات حفظ السلام الدولية من أكثر الأمور إثارة للجدل في القانون الدولي لعدم شمولية ميثاق الأمم المتحدة عليها. فقد أحدثت عمليات حفظ السلام التي يقررها مجلس الأمن تطورا جذريا للدور الذي يقوم به في مجال حفظ السلم والأمن الدوليين، فهناك من يرى أن إنشاء يتوسط بطبيعتها بين أعمال القمع وتدابير الحل السلمي. أما سلطة الجمعية العامة في إنشاء قوات السلام الدولية تستند إلى قرار الاتحاد من أجل السام الذي أحدث تحولا في سلطة هذه الأخيرة في مجال حفظ السلم والأمن الدوليين. كما تتطرق هذه الدراسة إلى الدور الذي تلعبه المنظمات الإقليمية في حفظ السلم والأمن الدوليين.
|b This study speaks to the legal regime of peacekeeping operations by identifying the legal framework that frames them, where the question of the legal nature of international peacekeeping operations is one of the most contentious in international law because of the non-universality of the Charter of the United Nations. The peacekeeping operations decided upon by the Security Council had radically evolved their role in the maintenance of international peace and security, and there were some who believed that the establishment of a mediation between repression and peaceful resolution measures of its nature. The General Assembly's authority to establish international peace forces is based on the Uniting for Peace resolution, which has transformed the latter's authority in the maintenance of international peace and security. This study also addresses the role played by regional organizations in the maintenance of international peace and security.
