|a هدفت الدراسة إلى بيان التقدير الشرعي لزكاة الصكوك الذكية، ويتفرع عنه الأهداف الآتية: توضيح ماهية الزكاة ومشروعيتها ومصارفها، وبيان ماهية الصكوك الذكية، بالإضافة إلى بيان زكاة الصكوك الذكية. توصلت الدراسة إلى أن الزكاة مبلغ من المال فرضه الله تعالى على مال المسلم يصرف لفئات معينة وضمن شروط معينة، وأن الصكوك الذكية أداة مالية جائزة شرعا تجب عليها الزكاة في حال توفر شروط الزكاة بها وتستخدم تقنية البلوكتشين ليتم عملها وفق قواعد العقد الذكي من دون الحاجة إلى وجود وسيط مالي، وتتيح الصكوك الذكية العديد من المزايا ولكنها في ذات الوقت تواجه العديد من التحديات، وأوصت الدراسة بالاهتمام بالصكوك الذكية من قبل المجامع الفقهية الإسلامية والجهات الشرعية الرسمية لإصدار أحكام وضوابط للتعامل بهذه الصكوك، وبذلك يتم ترويجها في عالم التمويل الإسلامي، بالإضافة إلى عقد ندوات ومؤتمرات علمية من أجل إجراء بحوث لتحسين وإثراء تجربة الاستثمار بالصكوك الذكية.
|b The study aimed to show the legitimate appreciation of Zakat Smart Sukuk, with the following objectives: to clarify what Zakat is, its legitimacy and its banks, and to indicate what Smart Sukuk are, by stressing Zakat Smart Sukuk. The study found that zakat is a sum of money imposed by God Almighty on the money of Muslims spent for certain categories and under certain conditions Smart Sukuk are a legally awarded financial instrument that must be Zakat if Zakat conditions are met and blockchain technology is used to operate by the rules of the smart contract without the need for a financial broker, Smart Sukuk offer many advantages but at the same time face many challenges The study recommended that attention be paid to Smart Sukuk by Islamic jurisprudence assemblies and official legitimate bodies to issue provisions and regulations to deal with these instruments; They are promoted in the world of Islamic finance, in addition to holding scientific seminars and conferences to research to improve and enrich the investment experience with Smart Sukuk.
