|a تستهدف هذه الدراسة البحث في موضوع استقلالية المجلس الأعلى للقضاء الجزائري وترصد تطور التشريع من خلال التعديلين الدستوريين 2016 و2020، لا وجود لاستقلالية المجلس الأعلى للقضاء في ظل تعديل 2016 بحكم تشكيلية المجلس التي يطبعها تفوق السلطة التنفيذية داخله، غير أن التعديل الدستوري لسنة 2020 أحدث إصلاحا كبيرا فيما يتعلق باستقلالية المجلس الأعلى للقضاء من خلال دسترة تشكيلته وتعديلها، وتوسيع صلاحياته ودسترها.
|b This study aims to research the issue of the independence of the Algerian Supreme Judicial Council and monitor the development of legislation through the 2016 and 2020 constitutional amendments. There is no independence of the Supreme Judicial Council in light of the 2016 amendment due to the composition of the Council, which is characterized by the superiority of the executive authority within it. However, the 2020 constitutional amendment brought about reform. Significantly regarding the independence of the Supreme Judicial Council through constitutional zing and amending its composition, and expanding and constitutional zing its powers.
