|a مبدئيا يمكن التمييز في إطار المساطر الإدارية بين نوعين: المساطر الإدارية غير القضائية وهي تتعلق بتنظيم علاقات غير تنازعية أي خارج إطار القضاء الإداري، ثم المساطر الإدارية القضائية والتي تهم العلاقات التنازعية خلال مختلف مراحل الطعن أمام كل من الإدارة ومحاكم القضاء الإداري. ويقصد بمسطرة المنازعات الإدارية: "القواعد الشكلية والإجرائية التي يتعين على المتقاضين اتباعها في رفع خصوماتهم إلى القضاء والتي يلتزم بها هذا الأخير أثناء سير الخصومة والحكم فيها". وبعيدا عن كل لبس فالمسطرة الإدارية الخاصة بمعالجة الطعون المرفوعة في القضايا الإدارية لا تختلف تماما عن المسطرة المتبعة من طرف القاضي الذي ترفع إليه الطعون في القضايا العادية.
|b In principle, it is possible to distinguish within the framework of administrative procedures between two types: non-judicial administrative procedures, which are related to regulating non-conflict relations, that is, outside the framework of the administrative judiciary, and then judicial administrative procedures, which concern conflictual relations during the various stages of appeal before both the administration and the administrative judiciary courts. The administrative dispute procedure means: “the formal and procedural rules that litigants must follow in submitting their disputes to the judiciary and which the latter adheres to during the course of the dispute and its adjudication.”
