|a يعد الزواج سنة طبيعية أقرتها كل المجتمعات البشرية والأديان السماوية، والزواج علاقة شرعية بين رجل وامرأة تهدف إلى تكوين أسرة على أساس المودة والرحمة والمحافظة على الأنساب، إلا أن بعض الأزواج قد تواجههم مشاكل العقم، وعدم قدرتهما على الأنجاب وهذا يشكل عائقا في الحياة الزوجية ما قد يضطر الزوجين إلى اللجوء لإجراء عملية التلقيح الاصطناعي والتي تعد من أهم الوسائل الطبية الحديثة التي أفرزتها التطور في مجال الطب للقضاء على مشكلة العقم، ومن هنا تأتي أهمية دور المشرع الجنائي في مواجهة أفعال الاعتداء الناجمة من عمليات التلقيح الاصطناعي، وذلك من خلال تجريم عملية الاصطناعي بنوعيه إذا ما تم دون رضا الزوجين أو أحدهما باعتبارها جريمة مستقلة ومساءلة الطبيب ومركز التلقيح الاصطناعي وزوج في حالة عدم رضا الزوجة.

Hence the importance of the role of the criminal legislator in confronting acts of aggression resulting from artificial insemination operations, by criminalizing both types of artificial insemination. If it is done without the consent of the spouses or one of them, it is considered an independent crime, and the doctor, the artificial insemination center, and the husband will be held accountable in the event of the wife’s dissent.
