|a موضوع البحث: رسالة في أدب المفتي للفقيه الحنفي محمد فقهي العيني، من فقهاء القرن الثاني عشر الهجري -تحقيق ودراسة -. هدف البحث: المشاركة في إحياء التراث الفقهي الإسلامي بتحقيق المخطوطات القيمة، وتقديمها للقارئ الكريم. منهج البحث: قام التحقيق على نسختين للمخطوط كلتاهما بخط المؤلف. إحداهما متأخرة عن الأخرى بثلاث سنوات، والمتأخرة منهما تمثل إبرازه ثانية للكتاب؛ جعلتها أصلا يقوم التحقيق عليه، ويثبت منها النص، والأخرى هي الفرعية استعين بها على قراءة النص وضبطه. نتيجة البحث: صحة نسبة الكتاب إلى مؤلفه، وسعة إطلاع المؤلف على كتب أصحابه، ودقته فيما ينقله عنهم، مع تبعيته العلمية لهم في الغالب، والاستقلال عنهم أو الاستدراك عليهم فيما ندر. التوصيات: العناية بتحقيق مخطوطات التراث الإسلامي؛ وخاصة المصنفات التي تؤلف في فن خاص.
|b Title of the research: A Treatise on the Ethics of Mufti Authored by the Hanafi Jurist Muhammad Faqhi Al-Aini, one of the Jurists of the Twelfth Century of Hijra. Research objective: Contributing to the revival of the Islamic jurisprudence heritage by investigating valuable manuscripts, and presenting them to the esteemed readers. Research methodology: The investigation was based on two copies of the manuscript, both were scripted by the author himself. One is three years later than the other. The last of them represents a second highlight of the book and I made it the primary copy to be investigated, from which the text will be copied. The other manuscript is the subordinate and was used in reading and editing the primary text. The findings of the research: The authenticity of ascribing the book to the author, the author’s vast knowledge of the literature of the scholars of his school of jurisprudence, and his accurate reporting of their ideas as he often relied on them for scholarly support although he also critiqued them on a few issues which demonstrate his independence. Recommendations: Paying attention to the investigation of Islamic eritage manuscripts, especially works that were written in a specific field.
