| 520 | |b Cyberspace has become an essential topic in international relations. A concept invented in science fiction, at the end of the 1980s, it entered the real world, impacting the military field and becoming entangled with civilian domains. Indeed, due to the construction and characteristics of cyberspace, in addition to the nature and size of its actors, state and non-state, international relations are impacted in its era. This in view of the opportunities it offers, but also because of the threats and challenges it generates. Based on this, effective regulation is essential. However, since international relations are governed by international law, this one must regulate cyberspace. As such, although the application of existing international law in cyberspace is recognized by a large number of States, certain limits and constraints persist. Faced with this situation, the prospects are divided between the adaptation and reinforcement of existing international law and the implementation of an international law of cyberspace sui generis. |d Le cyberspace est devenu un thème incontournable des relations internationales. Concept inventé dans la science-fiction, à la fin des années quatre-vingts, il a fait son entrée dans le monde réel, impactant le champ militaire et s’enchevêtrant avec les domaines civils. En effet, en raison de la construction et des caractéristiques du cyberespace, en plus de la nature et de la dimension de ses acteurs, étatiques et non étatiques, les relations internationales se trouvent impactées à son ère. Ceci au regard des opportunités qu’il offre, mais aussi à cause des menaces et des défis qu’il génère. Devant ce constat, une régulation efficace s’impose. Or, étant donné que les relations internationales sont régies par le droit international, celui-ci se doit de réglementer le cyberespace. A ce titre, bien que l’application du droit international existant dans le cyberespace soit reconnue par un grand nombre d’Etats, certaines limites et contraintes persistent. Devant cette situation les perspectives sont partagées entre l’adaptation et le renforcement du droit international existant et la mise en oeuvre d’un droit international du cyberespace sui generis. | ||
