|a يعتبر الحق في الحصول على المعلومات أحد الحقوق التي كرسها الدستور المغربي، وتحديدا الفصل 27 منه الذي يضمن هذا الحق ويعزز ثقافة الشفافية في مجال تدبير الشأن العام. بالإضافة إلى ذلك، تم إصدار القانون رقم 31- 13 بشأن الحق في الحصول إلى المعلومات سنة 2018، والذي يحدد مجالات تطبيق هذا الحق وشروط الولوج إلى المعلومات الموجودة بحوزة الإدارات العمومية والمؤسسات المنتخبة والهيئات المكلفة بمهام المرفق العام. على الرغم من هذا التأطير القانوني، فإن تفعيل هذا الحق لا زالت تواجهه العديد من التحديات. يحاول هذا العمل التعريف بطبيعة الحق في الحصول على المعلومات من خلال تسليط الضوء على الإقرار الدولي له وسياق دسترته بالمغرب، وكذا حمايته القانونية وحدود ورهانات تفعيله.
|b In Morocco, the Right of access to information is enshrined in the Constitution, specifically in Article 27, which guarantees this right and promotes transparency culture in management of public affairs. Additionally, the Law No. 31 -13 on the Right of access to information, enacted in 2018, defines the fields of application of this right and the conditions of access to the information held by public administrations, elected institutions and bodies charged with public service functions. Despite these legal frameworks, the implementation of right of access to information faces several challenges in Morocco. This article will attempt to shed light on the nature of this right by highlighting its international recognition and the context of its constitutionalization in Morocco, as well as its legal protection and the limits and stakes of its implementation.
