المستخلص: حرصت الشريعة على حفظ الحقوق في المعاوضات، ومن أهم تلك المعاوضات ما كان بين الزوجين، خصوصاً حال الفرقة والخصومة. والخلع هو أحد أنواع الفرقة بعوض، فيعقد له المجلس وله أحكامه الخاصة، وقد جاءت هذه الدراسة بعنوان (الخلع حقيقته وتكييفه الفقهي) لتوضح حقيقة عقد الخلع ونوعه، وتكييفه الفقهي الذي تنبني عليه الأحكام. وقد اقتضت طبيعة البحث أن ينتظم في مقدمة وثلاث مباحث، الأول: في نسبة الخلع، الثاني: حقيقة الخلع، والثالث: التكييف الفقهي لعقد الخلع وأثره؛ ثم خاتمة فيها أهم النتائج ومنها: أن الخلع مفارقة تنشأ من الزوج وإليه تنسب، وأن الراجح من أقوال الفقهاء أن الخلع يقع طلاقاً بائناً، وأن التكييف الفقهي لعقد الخلع على أربعة صور هي: المعاوضة، التعليق، الإقالة، والجعالة.

The Sharia has been keen on preserving rights in contracts, and one of the most important of these contracts is that which occurs between spouses, especially in cases of separation and dispute. "Khul' " is one form of divorce with compensation, and it is established by the council with its own regulations. This study is entitled "The Truth and Jurisprudential Adaptation of Khul' " and aims to clarify the essence of the Khul' contract, its various types, and its jurisprudential adaptation on which rules are based. The nature of the research required that it be organized in an introduction and three chapters. The first chapter is about the origin of Khul' while the second is about the nature of Khul'. The third chapter focuses on the jurisprudential adaptation of the Khul' contract and its impact. Then, a conclusion is presented that highlights the most significant findings, including the following: Khul' is a form of divorce initiated by the wife and attributed to her. The predominant view among jurists is that Khul' results in an irrevocable divorce. The jurisprudential adaptation of the Khul' contract can be categorized into four forms: Al-Mu'awadah, At Taleeq, Al-Iqalah, Al-Ja'alah.
