|a لازالت قضايا الاختفاء القسري، تثير المزيد من التساؤلات والإشكالات. حيث أن هذه العمليات والتي عادة ما تصاحب النزاعات المسلحة والحروب الأهلية، أو حتى خلال مواجهة الإرهاب في عدد من الدول. تشكل انتهاك لحق أصيل من حقوق الإنسان، وهو الحق في الحياة وعدم التعرض له، كذلك شفافية المعلومة حول مصير الإنسان. كل هذا جعل القانون الدولي يتصدى لمثل هذه الممارسات وضبط أركان هذه الجريمة، ومحاولة الحد منها من خلال إيجاد نصوص قانونية دولية تعنى بمواجهتها والمعاقبة عليها.
|b Cases of enforced disappearance continue to raise further questions and problems. These operations, which usually accompany armed conflicts and civil wars, or even during the confrontation of terrorism in a number of countries. It constitutes a violation of an inherent human right, the right to life and freedom from being subjected to it, as well as transparency of information about the fate of man. All this has made international law confront such practices and control the elements of this crime, and try to curb them by creating international legal texts dealing with their confrontation and punishment.
