المستخلص: تتناول هذه الدراسة موضوع جرائم زراعة ونقل الأعضاء البشرية وفقا للقانون الكويتي رقم (٥٥) لسنة ۱۹۸۷ م. حيث تطرقت إلى ما ورد به من نصوص تجريميه نظمت جريمة نقل أو زراعة الأعضاء البشرية من حيث خصوصية الركن المادي والمعنوي ومن أمثلتها جريمة نقل أو زراعة الأعضاء البشرية بطريق التحايل أو الإكراه وجريمة عمليات نقل أو زراعة الأعضاء البشرية في غير المراكز الطبية المرخص لها بذلك وجريمة الاتجار بالأعضاء البشرية. كما تناولت الدراسة جرائم نقل وزراعة الأعضاء من حيث النتيجة ومنها الشروع في جرائم نقل وزراعة الأعضاء وجريمة نقل الأعضاء من جسم إنسان لم تثبت وفاته كما تبنت هذه الدراسة المنهج المقارن وذلك ببيان موقف المشرع الكويتي بالمقارنة مع القانون المصري في بعض الجوانب. وقد توصلت هذه الدراسة إلى عدة نتائج وتوصيات للمشرع الكويتي منها ما يتعلق بضرورة إجراء تعديلات تشريعية ومنها ما يتعلق بضوابط قضائية ومنها ما يتعلق بضوابط إعلامية.

This study deals with the offences of transplantation and transfer of human organs in accordance with Kuwaiti Law No. (55) of 1987. This study also deals with a comparison with Egyptian law in some respects. This study has reached several findings and recommendations for the Kuwaiti legislator. It touched on the criminal texts that organized the crime of transferring or transplanting human organs in terms of the specificity of the material and moral element, examples of which are the crime of transferring or transplanting human organs by fraud or coercion, the crime of transferring or transplanting human organs in other than licensed medical centers, and the crime of trafficking with human organs. The study also dealt with crimes of organ transplantation and transfer in terms of the outcome, including the initiation of crimes of organ transfer and transplantation, and the crime of transferring organs from the body of a person whose death has not been proven. This study also adopted the comparative approach by clarifying the position of the Kuwaiti legislator in comparison with the Egyptian law in some aspects. This study has reached several results and recommendations for the Kuwaiti legislator, including those related to the necessity of making legislative amendments, including those related to judicial controls, including those related to media controls.
