|a جريمة التنمر من الظواهر القديمة في تاريخ البشرية باختلاف أسبابها وأساليبها، ودراسة هذه الظاهرة وسبل مواجهتها والحماية منها تُعد من التوجهات البحثية الحديثة في مجال القانون الجنائي، وهو ما تنبه إليه المشرع المصري مؤخراً، وأصدر القانون رقم (189) لسنة ۲۰۲۰م بتعديل بعض أحكام قانون العقوبات المصري الصادر بالقانون رقم (٥٨) لسنة 1937م، بإضافة المادة (۳۰۹) مكرراً (ب) إلى قانون العقوبات، والتي نصت على تعريف التنمر والعقوبات المقررة لهذه الجريمة، ويأتي اهتمام المشرع الجنائي نظراً لخطورة جريمة التنمر، وما يترتب عليها من الاضطرابات النفسية للمجني عليه وعلى المجتمع ككل، وهو ما يتطلب تدخل المشرعين لوضع نصوص قانونية من أجل مواجهة هذه الظاهرة.
|b The crime of bullying is one of the ancient phenomena in human history, with different causes and methods. Studying this phenomenon and ways to confront it and protect it is one of the modern research trends in the field of criminal law. This is what the Egyptian legislator recently drew attention to and issued Law No. (189) of 2020 to amend some provisions of the Egyptian Penal Code promulgated by Law No. (58) of 1937, adding Article (309) bis (b) to the Penal Code, which stipulated the definition of bullying and the penalties prescribed for this crime. The interest of the criminal legislator comes in view of the seriousness of the crime of bullying, and the consequent psychological disturbances on the victim and on society as a whole, which requires the intervention of legislators to develop legal texts in order to confront the phenomenon of bullying.
