|a تتلخص هذه الدراسة في حول الإنابة بين المحاكم الشرعية الأردنية وبين المحاكم الشرعية الأردنية ومن أجاز القانون إنابتهم من القناصل والسفراء والكتبة وغيرهم، وتحدثت الدراسة عن بيان حقيقة الإنابة فيما يخص موضوع البحث، وبيان الألفاظ ذات الصلة من الإنابة، وبيان وجوه التشابه والاختلاف، وبيان مشروعية الإنابة في الفقه الإسلامي والقوانين والتشريعات المعمول بها في المحاكم الشرعية الأردنية، بالإضافة إلى بعض القوانين المعمول بها في المحاكم النظامية. وتحدثت الدراسة عن سلطة القاضي في استخدام الإنابة واللجوء إليها والعدول عنها، وتحدثت عن شروط الإنابة المستخلصة من نصوص القانون، ثم بينت الدراسة التطبيقات العملية لأبواب الإنابة الواردة في القانون في التشريعات المعمول بها في المحاكم الابتدائية الشرعية، وبيان بعض القرارات الاستئنافية الشرعية حول الإنابة، ومن ثم الخاتمة والتوصيات.
|b This study is summarized in the matter of delegation between the Jordanian Sharia courts and between the Jordanian Sharia courts and those whose delegation is permitted by law, including consuls, ambassadors, scribes, and others. The study talked about explaining the reality of delegation with regard to the subject of the research, explaining the relevant terms of delegation, explaining the similarities and differences, and explaining the legitimacy of delegation. In Islamic jurisprudence and the laws and legislation applicable in the Jordanian Sharia courts, In addition to some of the laws in force in regular courts, the study spoke about the judge’s authority to use delegation, resort to it, and withdraw from it, and talked about the conditions for delegation extracted from the texts of the law. Then the study showed the practical applications of the chapters of delegation contained in the law in the legislation applicable in the Sharia courts of first instance. And a statement of some legal appeal decisions regarding delegation, followed by the conclusion and recommendation.
