|a يشكل النقاش حول براءات الاختراع والحصول على الأدوية تحديًا كبيرًا للمجتمع الدولي. وقد وضعت اتفاقية "تريبس" مجموعة من المرونات في خدمة الدول النامية تهدف إلى إيجاد التوازن المأمول بين المصالح المتضاربة لحقوق الملكية الفكرية من جهة، والحق في الصحة من جهة أخرى. ومع ذلك، فإن التفاوت بين النوايا والنتائج المحصل عليها لافتة للنظر، مما يجعل الحاجة ملحة إلى التفكير المستمر وتعميق الجهود المتضافرة لضمان حصول الجميع على الأدوية.
|b The debate on patents and access to medicines remains a major challenge for the international community. The TRIPS agreement has put established a set of flexibilities to service developing countries aimed at finding the hoped-for balance between the conflicting interests of intellectual property rights on the one hand, and the right to health on the one hand. However, the gap between intentions and expected results is striking, hence the need for continued reflection and concerted actions to ensure access to medicines for all.
|d Le débat sur les brevets et l’accès aux médicaments reste un défi majeur pour la communauté internationale. L’accord sur les ADPIC a mis en place un ensemble de flexibilités au service des pays en développement visant à trouver l’équilibre espéré entre les intérêts contradictoires, des droits de la propriété intellectuelle d’une part, et le droit à la santé d’une autre part. Or, le décalage entre les intentions et les résultats escomptés est frappant, d’où la nécessité d’une réflexion continue et des actions concertées pour garantir l’accès aux médicaments pour tous.
